يُعد الحد الفارق بين أملاك الدولة العامة وأملاك الدولة الخاصة استهداف المنفعة العامة، فما تملكه الأشخاص العامة مستهدفة المنفعة العامة يُعد من مفردات أملاك الدولة العامة، وما كان على سبيل الاستثمار والنفع الخاص يُعد من أملاكها الخاصة. وقد أضحى التمييز بين أملاك الدولة العامة وأملاك الدولة الخاصة نسبيا بشكل كبير، فالتداخل بين القواعد القانونية المنظمة لهما في كثير من الجوانب متسما بالمرونة مستهدفا الاستفادة المثلى من تلك<br/>الأملاك.<br/>فمن ناحية يُلاحظ أن الاتجاه التشريعي يخطو نحو إمكانية إنشاء حقوق عينية على أملاك الدولة العامة بموجب نماذج تعاقدية محددة، وقد ساهم الاجتهاد القضائي وتحت مظلة التشريع بتنميتها نطاقا وتعظيمها أهمية، كما أن المناخ القانوني السائد يسير تجاه التضييق من دائرة أملاك الدولة العامة نحو البحث عن أفضل أنواع استغلال الأملاك العامة. ومن ناحية ثانية رَسَمَ المُشرع سياسة دعم استثمار وازدهار أملاك الدولة الخاصة، حيث تناولها بالتنظيم التشريعي وفصل مجملها القضاء الإداري راسما بذلك نظرية متكاملة البنيان عمادها إضفاء قدر كبير من المرونة، وضرورة التوسع في دائرة الحفاظ على استقرار المراكز القانونية الفردية وحمايتها من المساس بها من خلال مبدأي الثقة المشروعة واستقرار العلاقات التعاقدية.<br/>وليحقق البحث غايته الأساسية من بيان مساهمة الاجتهاد القضائي في سبيل تحقيق الغايات التشريعية من أملاك الدولة، وإدراكه لتداعيات تلك التطورات، استعرض الباحث الأحكام القضائية التي أحدثت تحولاً للقضاء أو - على الأقل - عدولاً ظاهرا، مبينا مدى إمكانية اعتبار ذلك التحول أو ذاك العدول هو أفضل ما يكون في ضوء الموازنة بين الالتزامات الدستورية |

The main difference between public and private state property is the targeting of the public interest, what public entities own with the purpose of serving the public interest is considered part of the public state property, whereas what is intended for investment and private interest is considered part of the private state property. The distinction between public and private state property has become highly relative, as the overlap between their governing legal rules in many aspects is flexible and aims to optimize the use of public and private state property.<br/>On the one hand, it should be noted that the legislative trend is shifting towards enabling the creation of rem rights over public state property under specific contractual models. Within the framework of legislation, judicial precedents have contributed to broadening the scope and maximizing the importance of public state property. Moreover, the prevailing legal trend is shifting towards restricting the scope of public state property in favor of seeking the best utilization of public property. On the other hand, the Legislator has outlined a policy to support the investment and development of private state property, addressed in legislative regulation and detailed by the administrative judiciary; providing a comprehensive highly flexible theory, and necessitate better safeguarding the stability and protecting individual legal positions from interference through the principles of legitimate expectation and stability of contractual relations.<br/>To achieve the main goal of the research, which is to demonstrate the contribution of judicial precedents to fulfilling the legislative goals related to state property and understanding the implications of such developments, the researcher examines judicial decisions that have caused a significant shift in the judiciary, or at least - a notable change, showing the extent to which such a shift or change can be considered the best, considering the balance among constitutional obligations. |
