| Summary, etc. | يُعد موضوع الحماية المدنية من الإعلانات التجارية غير المشروعة، نتيجة للدور الذي يضطلع به الإعلان في الأنشطة التجارية، لذا كان لابد من تنظيمه تشريعيا لضمان حرية المنافسة المشروعة وحماية المستهلك في الوقت ذاته، فالإعلانات غير المشروعة تشكل اعتداء على القواعد التي تحكم المنافسة المشروعة بين التجار وتلحق الضرر بالمنافسين والمستهلكين، فإذا كانت الإعلانات تسهم إلى حد كبير - في إنعاش سوق المنافسة وتشجيعها من ناحية إلا أنها قد تضر بها من ناحية أخرى، عندما تنطوي على خداع أو تضليل للمستهلكين حول حقيقة المنتجات أو الخدمات محل الإعلان أو تتضمن تشويها وتحقيرًا للمنافسين أو منتجاتهم أو خدماتهم أو عندما تحدث خلطا أو لبسا في ذهن الجمهور بينها<br/>وبين المنتجات والخدمات المنافسة.<br/>ويتحقق الخداع في الإعلانات عندما تتضمن معلومات أو بيانات من شأنها أن توقع المستهلك في خداع أو تضليل فيما يتعلق بالمنتجات أو الخدمات، فالمعيار الذي يعتمد عليه في تحديد الطبيعة الخادعة للإعلان هو معيار موضوعي يعتمد على الرسالة الإعلانية ومدى قدرتها على خداع المستهلك العادي وتضليله، ولذلك لا يعد الإعلان خادعًا إذا كان ينطوي على قدر من المبالغة لا يمكن أن ينخدع بها؛ لأن المبالغة في الإعلانات تعد أمرًا مألوفًا، كما أنها لا تتضمن أي تشويه أو تحقير للمنتجات أو<br/>الخدمات المنافس. |
