| Summary, etc. | نظرا للدور الحيوي الذي تؤديه العقود النموذجية في مجال صناعة التشييد والبناء، فكان لا بد من إيجاد الأساس القانوني الذي يربط العلاقة بين رب العمل والمقاول لضمان التوازن المالي والقانوني بينهما، ويعد إنشاء مجلس تسوية المنازعات أحدث الوسائل التي ظهرت لتسوية الخلافات الخاصة بعقود المقاولات والإنشاءات الدولية؛ وذلك بغرض منع تفاقم الخلافات بين طرفي العقد من خلال التدخل السريع لحلها ، ويعد المقاول ورب العمل هما العنصريين الأساسيين في عقود المقاولات والإنشاءات الدولية، وترجع أهمية الاول لكونه المسئول عن تنفيذ وتسليم المشروع على النحو المتفق عليه ، وترجع أهمية الثانى لكونه صاحب فكرة المشروع، علاوة على أنه الطرف المنوط به سداد كافة المستحقات المالية اللازمة لاستكمال الأعمال على<br/>النحو المتعاقد عليه. |
