تناولنا في هذه الدراسة موضوع « أثر الحق النقابي على المركز القانوني للموظف العام في ليبيا " دراسة مقارنة بالقانونين الفرنسي والمصري " » . من خلال التقسيم الذي كانت عليه خطة هذا البحث، التي بدأت بمبحث تمهيدي، تتبعنا فيه الأساس الدستوري والتشريعي للحق النقابي الوظيفي في ليبيا وفرنسا ومصر . لبيان الأرضية التي يرتكز عليها وجود هذا الحق، وما ينشأ عنه من معطيات تفاوتت درجة ديمقراطيتها بين ليبيا والقانونين محل المقارنة . اتضح ذلك من خلال بيان دور النقابة لتفعيل الديمقراطية الإدارية، سواء عن طريق حق المشاركة في تحديد الأوضاع الوظيفية، أو حق الإضراب وانعكاسه على السلطة الرئاسية . ثم بينا الأثر المترتب على الديمقراطية الإدارية الناجمة عن الحق النقابي على مبدأ التدرج الرئاسي، ومظاهر التوازن بين المبدأين واختتمنا بحثنا هذا بالشق القضائي متجسدًا في دعوى الإلغاء، كوسيلة ضامنة لهذا الحق . وانتهينا إلى عرض الصعوبات التي وقفت حائلا أمام تفعيله لاسيما في ليبيا، والتي بناءًا عليها اقترحنا ثلة من التوصيات في النطاق الدستوري والتشريعي والقضائي فيما يخص ليبيا على وجه التحديد . مع الإشارة لبعض منها في مصر، والأقل منها بفرنسا والتي نأمل تحققها وصولا للمستوى المرجو ، لإحداث التوازن بين سلطة الإدارة وديمقراطيتها |

Through the division in which the plan of this research was, which began with an introductory study, we traced the constitutional and legislative basis for the right to trade union employment in Libya, France, and Egypt. To explain the basis on which the existence of this right is based, and the facts that arise from it, the degree of democracy varied between Libya and the two laws in comparison.<br/>This was made clear by explaining the role of the union to activate administrative democracy, whether through the right to participate in determining job conditions, or the right to strike and its impact on presidential authority.<br/>Then we showed the impact of administrative democracy resulting from the right to trade unions on the principle of presidential hierarchy, and the manifestations of the balance between the two principles.<br/>We concluded our research with the judicial aspect embodied in the cancellation lawsuit, as a means of guaranteeing this right, and we concluded by presenting the difficulties |
