| Summary, etc. | إن عقود الاستثمار الدولية تعد أحد أهم العوامل الأساسية لتحقيق التنمية الاقتصادية للدول، فحين تنجح الدولة في استقطاب الاستثمار الأجنبي تحسن حينها استغلال مواردها الطبيعية وهو ما يسهم في تطوير بنيتها التحتية، لذلك أصبح من متطلبات أي سياسية اقتصادية للدول؛ جذب أكبر قدر ممكن من رؤوس الأموال الأجنبية. وتتميز هذه العقود التي تبرمها الدول<br/>مع المستثمر الأجنبي بطبيعة خاصة سواء بالنظر إلى طبيعة أطرافها أو موضوعها، إلا أنه على الرغم من سعى أطراف العلاقة الاستثمارية إلى إنجاح اتفاقهما عن طريق تحديد أكبر قدر<br/>ممكن من الحقوق والالتزامات تجنبا لنشوب أي منازعات بينهما، إلا أنها كأي اتفاق قانوني ينشأ<br/>عنه منازعات بين أطرافه.<br/>ويعد المركز الدولي لتسوية منازعات الاستثمار أحد أهم مؤسسات التحكيم الدولية<br/>المتخصصة في الفصل في منازعات الاستثمار التي تنشأ بين الدولة المضيفة للاستثمار<br/>والمستثمر الأجنبي، ويحظى بقبول دولي واسع، تأسس تحت رعاية البنك الدولي للإنشاء والتعمير<br/>عام ١٩٦٥ ، ويهدف إلى تشجيع الاستثمار الأجنبي من خلال توفير مناخ استثماري ملائم، مما<br/>يساعد على تحقيق التنمية الاقتصادية التي تستهدفها الدول والموازنة بين مصالح المستثمر<br/>الأجنبي والدولة المضيفة، على الرغم من أنه لا يقوم بالفصل في هذه المنازعات بنفسه، وإنما<br/>يقتصر دوره على تسهيل إجراءات التوفيق والتحكيم بين الأطراف المتنازعة وفقا لأحكام اتفاقية<br/>واشنطن لعام ١٩٦٥. |

| Summary, etc. | International investment contracts play a major role in driving economic development for nations. When a country successfully attracts foreign investment, it enhances its utilization of natural resources, leading to infrastructural advancements. Consequently, the attraction of significant foreign capital has become imperative for any state's economic policy. These contracts, formed between states and foreign investors, possess distinct characteristics in terms of the nature of the parties and their subject matter. However, despite the parties' efforts by defining as many rights and obligations as possible to avoid any future disputes between them, like any legal agreement, conflicts can arise between the parties.<br/>The International Centre for Settlement of Investment Disputes (ICSID) serves as a prominent specialized international arbitration institution that resolves investment disputes arising between the host state and the foreign investor. Enjoying broad international acceptance, the institution was established under the auspices of the International Bank for Reconstruction and Development in 1965. Its primary objective is to foster a favorable investment climate that encourages foreign investment, thereby facilitating the targeted economic development of countries while balancing the interests of both the foreign investor and the host state. While the ICSID does not itself render decisions on these disputes, it plays a facilitating role in conciliation and arbitration procedures between the disputing parties in accordance with the provisions of the Washington Convention of 1965. |
