يعد حق الخصوصية حقا أصيلا للإنسان كفله مختلف الشرائع والأنظمة باعتباره جزءا لا يتجزأ من الكرامة الإنسانية. ويقوم على افتراض أن استقلالية الفرد أمر أساسي للحرية الفردية وتقرير المصير. لقد غيرت التكنولوجيا الراهنة في أشكال وأساليب الاتصال، وأدت إلى ثورة إعلامية ومعلوماتية أبرزت إمكانات هائلة للتواصل البشرى متجاوزة حدود الزمان والمكان، وهو ما يُعرف بالإعلام الرقمي. ومع ازدياد وسائله أصبح الفرد مقيدا ببصماته<br/>الرقمية التي ترصد وتجمع بياناته الشخصية وتجعلها متاحة للاختراق ويزداد فرص إساءة استخدامها.<br/>تتناول الدراسة الأطر التشريعية لحق الخصوصية في النظام الدولي من خلال المعاهدات، والمواثيق والمؤتمرات الدولية، وقرارات الجمعية العامة للأمم المتحدة، والتكريس الدولي لحق النسيان الرقمي وعلاقته بحق الخصوصية. كما تعرض وتحلل النصوص القانونية، والعناصر الأربعة لانتهاك الخصوصية بالولايات المتحدة الأمريكية، وسياسية التجسس والمراقبة الإلكترونية للاتصالات. كما تناقش الرسالة في التشريع المصري الحماية الجنائية لحرمة الحديث الخاص، والحق في الصورة، والمسكن، والسمعة، ومكافحة التنمر . ويطرح الباحث طبيعة الجرائم المرتكبة بوسائل الإعلام الرقمي وأشكالها مثل انتهاك الخصوصية، والسب والقذف بواسطة الهاتف، وإساءة استعمال أجهزة الاتصالات، فضلا عن جرائم التشهير الرقمي، والابتزاز الإلكتروني، والتحرش الجنسي الإلكتروني،<br/>والتزييف العميق، كما يلقي الضوء على الصور المستحدثة للجرائم السيبرانية.<br/>وقد أدت القدرات الفائقة لتطبيقات الذكاء الاصطناعي إلى تطوير تقنيات الواقع المعزز والافتراضي، وقراءة أفكار المستخدمين والتلاعب بها من خلال الانحياز الخوارزمي ومنهجيات الهندسة الاجتماعية، مما أدى إلى تفاقم التحديات التي تواجه الخصوصية الرقمية، والتي تشمل تحديد هوية المستخدم، وملفات تعريف الارتباط، والبيانات الضخمة، والبيانات الوصفية، ومخاطر "الميتافرس، و شات جي بي تي. وتستعرض الدراسة الحماية الجنائية الدولية للخصوصية الرقمية، والوطنية مثل قانون رقم ۱۸۰ لسنة ۲۰۱۸ بشأن تنظيم الصحافة والإعلام والمجلس الأعلى لتنظيم الإعلام، وقانون مكافحة جرائم تقنية المعلومات رقم ۱۷۵ لسنة ۲۰۱۸ ، وقانون حماية البيانات<br/>الشخصية رقم ١٥١ لسنة ٢٠٢٠.<br/>إن البيانات تزود من يمتلكها بالقوة، والبيانات الضخمة تزود من يمتلكها بالقوة الهائلة، وكل قوة قابلة في الحقيقة لسوء الاستخدام. لذلك يستهدف الباحث وصف وتفسير الحماية الجنائية لحق الخصوصية بوجه عام، والخصوصية الرقمية بوجه خاص لاستنباط جوانب القوة والضعف في المعاهدات والمواثيق الدولية، ومقارنة النصوص القانونية الأمريكية مع المصرية للكشف عن جوانب القصور واقتراح البدائل لسد الثغرات. |

The right to privacy is an inherent human right guaranteed by various canons and regulations as an integral part of human dignity. It is based on the assumption that the autonomy of the individual is fundamental to individual freedom and self- determination. The current technology has changed the forms and methods of communication beyond the boundaries of time and space, which is known as digital media. With the increase in its means, the individual has become constrained by his digital footprints, which monitor and collect his personal data, make it available for hacking, and increase the chances of its misuse.<br/>The study examines the legislative frameworks of the right to privacy in the international system through treaties, charters, international conferences, resolutions of the UN General Assembly, the international consecration of the right to be forgotten, and its relationship to the right to privacy. It also presents and analyzes the legal articles, the elements of the violation of privacy in the United States of America, and the policy of espionage and electronic surveillance of communications. The study also discusses the criminal protection of the inviolability of private speech, the right to image, housing, reputation, and the fight against bullying in Egyptian legislation. The researcher presents the nature of crimes committed by digital media and their forms, such as violations of privacy, swearing and slander by phone, misuse of communication devices, as well as digital defamation crimes, electronic blackmail, electronic sexual harassment, and deepfakes, and also sheds light on the updated types of cybercrimes.<br/>The superior capabilities of artificial intelligence have led to the development of augmented and virtual reality technologies, reading and manipulating users' thoughts through algorithmic bias and social engineering methodologies, exacerbating the challenges facing digital privacy, which include user identification, Cookies, big data, metadata, the dangers of Metaverse and ChatGPT. The study reviews both the international and national criminal protection of digital privacy, such as Law No. 180 of 2018 the regulation of the press and media, Law No. 175 of 2018 on Combating Information Technology Crimes, and Law No. 151 of 2020 on Personal Data Protection<br/>The aim of the researcher is to describe the criminal protection of the right to privacy in general and digital privacy in particular to deduce the strengths and weaknesses of international treaties and covenants and compare the American legal articles with the Egyptians to reveal the shortcomings and propose alternatives to fill the gaps. |
