| Summary, etc. | الحق في الحياة الخاصة هو أحد أهم الحقوق المتأصلة في الإنسان واللصيقة بشخصيته. ولهذا تضمنت القوانين المقارنة أشكال الحماية المختلفة له، والتي منها المدني والجنائي، إلا أنه توجد صعوبة في حماية هذا الحق، ويرجع ذلك إلى عدم وضوح مفهومه وعدم وجود حصر للعناصر أو الصور التي تتألف منها الحياة الخاصة، وعلى الرغم من أن الفقه والقضاء قد لعبا دورًا فاعلا في هذا المجال، لاسيما وأن الأخير قد ساعد في حماية الحياة الخاصة إلى حد كبير، وهذا الدور ليس سهلا؛ خاصة في حالة وقوع انتهاك الحياة الخاصة بواسطة وسائل الاتصالات الحديثة، ومما يحسب للقضاء في هذا الإطار أنه تمكن من الموازنة بين الحق في الحياة الخاصة، وحق آخر ذى أهمية كبيرة في الوقت الحاضر وهو الحق في الإعلام وحرية التعبير، ومع ذلك تظل الجهود المبذولة من جميع الجهات سواء المشرع أو الفقه أو القضاء غير ذات جدوى أو على أقل تقدير ليست كافية لحماية الحق في الحياة الخاصة من الانتهاك أو المساس به لاسيما في ظل الأخطار التي تهدد هذا الحق بسبب انتشار وسائل الاتصالات الحديثة وتطورها باستمرار واستخدامها بصورة لا تراعي حرمة هذا الحق أو خصوصيات الآخرين، إضافة إلى عدم وجود التشريعات أو التكييف القانوني أو القضائي الواضح لمواجهة تلك<br/>الانتهاكات. |
