| Summary, etc. | يأتي هذا البحث تعبيراً عن حالة عملية عالجها المنظم في نظام المرافعات الشرعية السعودي، وهي حالة اتفاق الخصوم على وقف الخصومة بإرادتهم، لمدة لا تزيد على ستة أشهر، وذلك من تاريخ إقرار المحكمة لهذا الاتفاق. ويترتب على هذا الوقف بطلان أي إجراء يتم خلال مدة الوقف نتيجة اعتبار الخصومة راكدة<br/>بالرغم من قيامها أمام القضاء.<br/>أما عن مصير الخصومة الموقوفة ونهاية الوقف، فقد تستأنف الخصومة سيرها من جديد من عند النقطة التي أوقفت عندها، وهذا يسمى بتعجيل الخصومة وذلك خلال ميعاد العشرة أيام التالية لنهاية مدة الوقف، وقد يهمل الخصوم تعجيلها، وبالتالي تعتبر هذه الخصومة متروكة، كجزاء توقعه المادة (۸۲) من النظام على الخصوم نتيجة تقصيرهم في متابعة السير في الخصومة.<br/>وقد جاء هذا البحث مقسما إلى مبحثين : الأول تحت عنوان ماهية وقف الخصومة الاتفاقي وفيه بيان لمفهوم وقف الخصومة الاتفاقي وشروط تحققه. والثاني مخصص لدراسة الآثار التي تترتب على وقف الخصومة الاتفاقي ومصير هذه الخصومة. |

| Summary, etc. | This article represents an analysis of a practical situation regulated by the Saudi Civil Proceedings Regulation of 1421 H. This situation is the litigants' agreement to suspend the litigation at their own will, for a period not exceeding six months from the date of the courts' approval to this agreement. Such suspension of the litigation leads to the invalidity of any procedure undertaken during the suspension period, because the litigation is considered at a halt even though it is still filed before the judiciary.<br/>With regards to the consequence of the suspended litigation and the end of the suspension, the litigation may be resumed, from the point at which it was suspended, within ten days following the end of the suspension period. This process is called the "resumption of the litigation". However, some litigants may not resume the litigation, which would then be considered as abandonment of the litigation as a penalty imposed upon the litigants by virtue of Article 82 of the 1421 Regulation for their dereliction.<br/>This article is divided into two sub-topics: The first discusses the concept, nature and conditions of the agreement to suspend the litigation; while the second discusses the effects of such an agreement as well as the consequence of the litigation. |
