| Summary, etc. | تعد جرائم البلطجة من الجرائم التي تمس أمن الأفراد وتبث الترويع والتخويف في النفوس، ومشكلة البلطجة مشكلة إجتماعية سيكولوجية في المقام الأول ، لذلك أثر المشرع مجابهة هذا الاجرام جنائياً لحين تحقق الوعى والإصلاح حيث أنهم يأخذان وقت طويل من الزمن. فجرم المشرع جل الأفعال التي يعد إرتكابها جريمة بلطجة ووفقاً لذلك التجريم تعد هذه الجرائم من حيث الطبيعة القانونية جرائم شكلية، فلم يتطلب المشرع حدوث نتيجة إجرامية لتحقق الركن المادى وبينا الفارق بين الجرائم الشكلية وجرائم الخطر، وأوضحنا أن جرائم الخطر تعد من الجرائم ذات النتيجة، لذلك من الأفضل هجر هذا التقسيم التقليدى للجرائم وفقاً لمعيار النتيجة - الجرائم المادية والشكلية وجرائم<br/>الضرر والخطر - ويحل محله التقسيم إلى جرائم ذات نتيجة وجرائم شكلية . ولم يكتفى المشرع فيما يتعلق بالركن المعنوى لجرائم البلطجة بالقصد الجنائي العام بل<br/>استوجب لتحقق هذا الركن قصد خاص هو قصد الترويع والتخويف .<br/>واتبع المشرع للعقاب على هذه الجرائم سياسة عقابية تحد قليلاً من فكرة تفريد العقاب فبدت هذه السياسة متشددة فلم يتبع المشرع نظام العقوبات التخييرية ونص وجوباً على انه عند الحكم بعقوبة يجب على القاضي الحكم بوضع المحكوم عليه تحت مراقبة الشرطة مدة مساوية لهذه العقوبة، فليس للقاضي أية سلطة تقديرية في إهمال الحكم بهذه المراقبة أو تعديلها، نظراً لأن هذه الجرائم تمس ركائز أساسية يقوم عليها<br/>بنيان المجتمع وبقائة . |

| Summary, etc. | Crimes of thuggery are crimes that impact individuals' security, spreading terror and intimidation in society. Thuggery is primarily a social and psychological issue. Consequently, legislators prefer to address this crime through legal means until awareness and reform are achieved, given the considerable time required for these processes. The legislator, therefore, criminalises most actions constituting thuggery. According to this criminalisation, these crimes are formal in nature. The legislator does not require the occurrence of a criminal result to establish the material element. We distinguish between formal crimes and crimes of danger, clarifying that crimes of danger involve a criminal result. Therefore, it is better to abandon the traditional classification of crimes based on result-material and formal crimes, crimes of harm and danger and replace it with a classification of crimes with a result and formal crimes.<br/>The legislator, concerning the moral element of crimes of thuggery, did not suffice with the general criminal intent but required a specific intent. This specific intent is the intent to intimidate and instil fear.<br/>In punishing these crimes, the legislator adopted a punitive policy that deviates from the idea of discretionary punishment. This policy appears stringent, as the legislator did not follow a system of optional penalties and mandated, as a rule, that when a punishment is imposed, the judge must order the convicted person to be placed under police surveillance for a period equal to the duration of the sentence. The judge has no discretionary authority to neglect or modify the imposition of this surveillance. This is because these crimes affect the fundamental pillars upon which the structure and sustainability of society rely. |
