يعد القانون الجنائي من أصعب وأدق التشريعات القانونية التي تستلزم الوقوف على خصوصيته التي تميزه عن باقي التشريعات القانونية الأخرى؛ يظهر ذلك في مجالات التجريم والعقاب والمحاكمة؛ حيث تتطلب معرفة خاصة بالواقع المجتمعي وما يحركه من تناقضات كانت وما تزال وستظل مصدره ومعينه الأول، وذلك لتطور المصالح المجتمعية واجبة الحماية جنائيا، وكذلك تخصيص النظر في مختلف أفعال المساس التي تهددها، مع ترتيب مستويات حمايتها من دون اختزال أو مبالغة في حماية المجتمع، إذ أن الفرد يرتكب هذه الأفعال متعديًا على حقوق وضمانات واجبة الحماية بداية من تحديد مسئوليته، وانتهاء بحسم تورطه في ارتكاب أي من الأفعال التي نص القانون على تجريمها.<br/>ولعل الصعوبة تنطلق بداية من أن لهذا القانون مصطلحات خاصة به، وهذه المصطلحات على الرغم من وجودها فقد شدد الفقه المقارن على ضرورة الالتزام بواجب الدقة والوضوح عند صياغتها؛ لأنها غالبا ما تكون حمالة لكثير من المعاني والدلالات؛ مما يوجب على دارس هذه المادة أن يعي منذ البداية بأنه مطالب بكثير من التريث والتأمل في نصوص تلك القواعد الجنائية حتى يحسن فهمها ويتمكن من تطبيقها وفق الشكل المستساغ<br/>دون انحراف بالنص أو تشويه للواقع. |

Because it is often a carrier of many meanings and connotations. Which requires the student of this subject to be aware from the beginning that he is required to take a lot of patience and contemplate the texts of these criminal rules in order to improve his understanding of them and be able to apply them according to the palatable form without deviation from the text or distortion of reality. |
