| Summary, etc. | هدفت هذه الدراسة إلى بيان إمكانية تطبيق القواعد القانونية غير الصادرة عن دولة معينة أمام القضاء في أوروبا في ظل تشريع روما رقم واحد بشأن القانون الواجب التطبيق في شأن الالتزامات التعاقدية. وقد توصلت الدراسة إلى مجانبة تشريع روما للصواب عندما حرم الأفراد من مكنة اختيار قانون غير صادر عن دولة معينة.<br/>وقد توصلت الدراسة إلى أنه كان يمكن تبرير موقف تشريع روما لو إقتصر المنع على اختيار أعراف التجارة الدولية، أو القواعد الدينية. غير أن حرمانهم من إختيار قواعد قانونية غير صادرة عن دولة معينة كاختيارهم لاتفاقية فينا أو المبادئ الأوروبية في العقود مثلا كان مجانب للمنطق |

| Summary, etc. | This study aims to explore the scope of applying non-state<br/>law in litigation within Europe under the Rome I Regulation.<br/>The study concludes that the attitude of the Rome I<br/>Regulation, by depriving parties from choosing non-state<br/>law, is unjustifiable. This attitude could be wise if the non-<br/>state law is no more than the Lax Moratoria and religious<br/>rules. Yet, there are other components of non-state law<br/>which must be acceptable like the (CISG) and the<br/>UNIDROIT Principle or the PECL which are 'hard laws'. |
