الإفتاء مهنة تقوم على أسس دستورية وقانونية راسخة، كما تقوم على قواعد وأعراف مهنية مستقرة. وكل من فقهاء القانون المدني والفقه الإسلامي متفقون على أن هناك ثمة التزامات واجبة على المفتي، يجب عليه احترامها وعدم الإخلال بها، سواء كانت هذه الالتزامات مصدرها العقد، أم القانون، أم الشرع، أم العرف الإفتائي وقواعد أخلاقيات المهنة . والإخلال بأي من هذه الالتزامات يوجب قيام المسئولية في مواجهة المفتي طالما توافرت أركانها، وهي الخطأ والضرر وعلاقة السببية بينهما. ويترتب على قيام هذه المسئولية وجوب التعويض وإزالة الضرر. أما إذا توافر السبب الأجنبي، فإن مسئولية المفتي لا تنعقد لانقطاع رابطة السببية بين الضرر والخطأ<br/>ونظرًا لافتقادنا لنصوص قانونية حاسمة تحدد وتوصف أهل الاختصاص بالفتوى؛ فإن القواعد العامة للمسئولية تظل قاصرة في مواجهة المعتدين على الإفتاء من غير أهله، ولما كان الأمر كذلك، كان من أكد الواجبات على الدولة رعاية وتنظيم الإفتاء، وإيجاد دور رقابي لها على شئون الفتوى والمفتين، وهو الأمر الذي عالجه البحث في أخر البحث باقتراح مشروع قانون ينظم<br/>شئون الفتوى في مصر. |

Fatwa is a profession that based on constitutional and legal <br/>foundations, as well as, stable professional rules and norms. Each of the civil <br/>law and Islamic jurisprudence agree that there are obligatory obligations for <br/>Mufti, in which should be respected and not violate, whether these obligations <br/>come from the contract, the law, the Sharia, or Fatwa or the rules of ethics of <br/>the profession. <br/>On the other side, the breach of any of these obligations necessitates the <br/>fulfillment of the responsibility over the Mufti in case of existing two elements, <br/>which are: error, damage and the causal relationship between them. As a result <br/>of this responsibility the obligation of compensation and elimination of harm, <br/>but if there is a foreign cause, the responsibility of the Mufti is not held because <br/>the causal link between harm and error is interrupted. <br/>Upon the lack of decisive legal texts that define and describe the <br/>specialists in Fatwa; The general rules of responsibility remain limited in the <br/>face of those who attack Fatwas, the most important duties of the State to <br/>sponsor and organize Fatwa, and to create a monitoring role over the affairs of <br/>Fatwa and Muftis, it was addressed by the research by proposing a draft law <br/>that organizes the affairs of the fatwa in Egypt. |
