يعد الحق في الاجتماع والتظاهر السلمى أحد المبادئ الأساسية التي لا تخلو الدساتير الديمقراطية من النص عليها، وهو الأسلوب المتحضر للضغط على الحكومات لتلبية مطالب المتظاهرين سلميا، من أبرزها الإعلان العالمي لحقوق الإنسان الصادر عام ١٩٤٨ ، والعهد الدولي الخاص بالحقوق المدنية والسياسية الصادر عام ١٩٦٦ ، الذي تضمن الاعتراف بالحق المذكور، وعدم جوزا وضع قيود على ممارسته، إلا أن تلك التي تفرض طبقا للقانون وتشكيل التدابير الضرورية في المجتمع الديمقراطي، لصيانة الأمن القومي والسلامة العامة لكل أفراد المجتمع، وتضمن ميثاق الحقوق الأساسية للاتحاد الأوروبي، على أن لكل إنسان الحق في حرية التجمع السلمي<br/>ونص الدستور المصري الصادر في ۱۸ يناير سنة ۲۰۱٤ على كفالة حرية الرأي والفكر بكل الطرق وأعطى الحق في تكوين الاجتماعات السلمية مشترطا الإخطار المنظم بالقانون.<br/>وقد حرص مجلس الدولة المصري والمحكمة الإدارية العليا منذ نشأتهما على إخضاع قرارات<br/>الضبط الإداري المتعلقة بحرية التظاهر السلمي للرقابة والتحقيق من سلامة وزن الإدارة وتقديرها<br/>الأهمية وخطورة الوقائع التي استند اليها قرارها. |

The right to peaceful assembly and demonstration is one of the basic principles that democratic constitutions are not devoid of stipulating, and it is the civilized method of pressuring governments to meet the demands of peaceful demonstrators, most notably the Universal Declaration of Human Rights issued in ١٩٤٨, and the International Covenant on Civil and Political Rights issued in ١٩٦٦ which It guarantees recognition of the aforementioned right, and the impermissibility of placing restrictions on its exercise, except those imposed in accordance with the law and the formation of necessary measures in a democratic society, to maintain national security and public safety for all members of society, and guarantees the Charter of Fundamental Rights of the European Union, provided that every human being has the right to freedom of assembly. The peaceful one.<br/>The Egyptian Constitution issued on January ۱۸ ۲۰۱٤stipulated that freedom of opinion and thought be guaranteed in all ways and gave the right to form peaceful meetings, requiring regulated notification of the law.<br/>Since their inception, the Egyptian Council of State and the Supreme Administrative Court have been keen to subject administrative control decisions related to freedom of peaceful demonstration to oversight and to investigate the integrity of the administration's weight and its appreciation of the importance and seriousness of the facts on which its decision was based. |
