إن التطور الصناعي والتكنولوجي أدى بلا شك إلى ظهور شركات ضخمة وتكتلات اقتصادية ، وقد صاحب ذلك تطور في أساليب أو طرق توزيع السلع والمنتجات وتقديم الخدمات ، وما استتبعه من ظهور آليات متعددة ومتنوعة يتم من خلالها تسويق السلع والمنتجات ، أصبحت معه صور عدم المساواة أكثر عمقاً ووضوحاً وأخذت أشكالاً جديدة ، ونتيجة لذلك انعدمت المفاوضة والمناقشة في نطاق العقد ، وكان لهذا الواقع انعكاسه في نطاق القانون فظهرت فكرة عقود الإذعان، وقد صاحب ذلك زيادة نسبة المخاطر والأضرار التي يتعرض لها المستهلك المذعن الأمر الذي أضحت معه حماية المستهلك المذعن تحتل أهمية كبيرة ، وكان لابد من الاستعانة بالوسائل التي تحقق الحماية المنشودة للمستهلك بعد أن عجزت القواعد العامة عن تحقيق هذه الحماية ، فكانت وسائل الحماية طبقاً للقواعد الخاصة الواردة في قوانين حماية المستهلك ؛ خير معين للمستهلك المذعن للحصول<br/>على الحماية المنشودة . |

The industrial and technological development undoubtedly led to the emergence of large companies and economic blocs. This development was accompanied by an evolution in the ways or methods of distributing goods, products and services. Also it followed by the emergence of multiple and varied mechanisms through which the markting of goods and products is carred out. Thus, the images of inequality have become more profound and unambigous and it has taken new forms. As a result, there was no negotiation and discussion within the scope of the contract. This reality reflected in the scope of law so the idea of adhesion contracts has emerged. This accompanied by an increase in the risks percentage and harms suffered by the aquiescent consumer.Accordingly the concept of protecting the aquiescent consumer has become very vital and it was inevitable to seek the assistance of means which achieve the desired protection for the consumer after the general rules have failed to achieve this protection. The methods of protection were in conformity with the special rules provided in the consumer protection law and particulary were good for the consumer who is seeking to obtaining the desired protection |
