يكتسب تطبيق أحكام القانون الخاص علي المنازعة الإدارية أهمية كبيرة، لما<br/>يثيره من إشكاليات في الواقع العملي، نظراً لاختلاف روابط القانون الخاص في طبيعتها عن روابط القانون العام. ومن ثم انصب موضوع هذه الدراسة علي البحث في خصوصية المنازعة الإدارية، بإبراز ماهيتها وتحديد طبيعتها وأهم ما تتميز به وتأثير ذلك علي الأحكام التي تخضع لها في الشكل والموضوع وتطلب ذلك بحث<br/>النواحي الإجرائية من جهة والنواحي الموضوعية من جهة أخري. وبناء عليه؛ كان حرياً بنا أن نبحث مدي إمكانية تطبيق أحكام قانون المرافعات<br/>علي المنازعة الإدارية في مرحلة الدعوي ومرحلة الطعن.<br/>وتبين من البحث أنها تخضع لأحكام قانون مجلس الدولة، ثم لأحكام قانون المرافعات فيما لم يرد فيه نص في قانون مجلس الدولة، بشرط ألا يتأبي الحكم<br/>وطبيعة المنازعة الإدارية.<br/>ثم أعقبنا ذلك ببحث مدي سريان أحكام القانون المدني علي المنازعة الإدارية؛ سواء في ذلك منازعة الإلغاء أو منازعات القضاء الكامل. |

The application of the provisions of the private law to the administrative disputes has a great importance because of the problems it raises in practice, due to the difference between relations of private law in nature to the public law, then the study focused on searching the confidentiality of administrative disputes, through highlighting what it is, determining its nature, what is the most important features and the impact on its provisions at the form and merits, then we have to discuss the procedural aspects on one hand and the substantive aspects on the other hand.<br/>Therefore, we might discuss the extent to which the provisions of the Procedural law can be applied to administrative disputes at the litigation and the appeal stage.<br/>It was found from the research that it is subject to the provisions of the State Council Law, then to the provisions of the Procedural Law; where there is no provision in the law of State Council, provided that the judgment and the nature of the administrative disputes are not rejected.<br/>Then we followed that by examining the extent to which the provisions of the Civil law apply to administrative disputes, whether in the annulment disputes or in the full judiciary disputes. |
