إن القانون هو مجموعة من الحقوق والالتزامات أو مجموعة من القواعد التي تنظم سلوك الأفراد في المجتمع على نحو ملزم لاقتران هذه القواعد بجزاء<br/>توقعه السلطة العامة على من يخالفها.<br/>ونحن في هذا الصدد ينصب اهتمامنا عن القانون الإداري، الذي هو جزء من القانون العام، وهو أحد الدعائم التي يعتمد عليها نجاح الإدارة الحديثة في تسيير المرافق العامة، ويهدف إلى إضفاء طابع المرونة على نظام العمل بما يكفل سريان النشاط الإداري<br/>فقد أدى اتساع مجالات النشاط العام في الدولة الحديثة إلى عدم إمكان الاكتفاء بالقانون الصادر عن السلطة التشريعية مصدرا وحيدا للقواعد القانونية وإلى ضرورة الاعتراف للإدارة ولأجهزتها الفنية المتخصصة بحق التشريع في تلك المجالات التي يعجز عن مواجهتها ممثلوا الأمة في البرلمان.<br/>فقد تطرأ ظروف استثنائية تقتضي تنظيما سريعا لا يحتمل التأخير، وتتطلب إجراءات تتخذها السلطة الإدارية بما لها من قدرة على سرعة الحركة. |

The law is a set of rights and obligations, or a set of rules that regulate the conduct of individuals in society in a binding manner, to associate these rules with the penalties imposed by the public authority on those who violate them.<br/>In this regard, we focus on administrative law, which is part of common law, and one of the pillars upon which the modern management of public administration is dependent. It aims at making the work system more flexible in order to ensure the entry into force of administrative activity.<br/>The broadening of the spheres of public activity in the modern State has led to the inability of the legislative branch to be the sole source of legal norms and to the need for recognition by the Department and its specialized technical bodies of the right to legislate in those areas which the representatives of the nation cannot face in Parliament. |
