في قوانين وأنظمة دول مجلس التعاون الخليجي . تناولت الدراسة النظام القانوني للهيئات والمؤسسات العامة في قوانين وأنظمة دول مجلس التعاون الخليجي ، من خلال فصل تمهيدي وبابين ، ففي الفصل التمهيدي تم بيان مفهوم الهيئة والمؤسسة العامة وأهميتهما في النظام القانوني ، حيث تم عرض فكرتي الهيئة والمؤسسة العامة باعتبارهما من طرق إدارة المرافق العامة، وتم تمييزهما عن المشروعات والتنظيمات الأخرى المشابهة لهما مع ذكر خصائص الأنواع المختلفة للهيئات المؤسسات العامة الإدارية والاقتصادية والاجتماعية والمهنية. وفي الباب الأول تناولت الدراسة التنظيم القانوني للهيئات والمؤسسات العامة كإنشائهما وانتهائهما ، وأسس الإدارة العامة لهما ، بالإضافة إلى بيان النظام القانوني لأعمالهما والنظام القانوني للعاملين بهما والنظام القانوني لأموالهما، وفي الباب الثاني تناولت الدراسة الرقابة الإدارية والرقابة القضائية على الهيئات والمؤسسات العامة في قوانين وأنظمة دول مجلس التعاون الخليجي، فتم عرض السلطة شبه الرئاسية للوزراء على أعمال الهيئات والمؤسسات العامة وكذلك السلطة الوصانية للوزراء على الهيئات والمؤسسات العامة بالإضافة إلى بيان السلطة الوصائية للحكومة ممثلة في مجلس الوزراء على الهيئات والمؤسسات العامة التي لا تتبع وزيراً معيناً، ثم تم تقييم نظم الرقابة المختلفة على نشاط الهيئات والمؤسسات العامة واستعراض جهات الرقابة الأصلية والمعاونة، ثم تناولت الدراسة الرقابة القضائية من خلال رقابة القضاء الإداري على التصرفات القانونية للهيئات والمؤسسات العامة، حيث تم بيان كل من رقابة الإلغاء ورقابة التعويض، وكذلك رقابة القضاء الإداري للأعمال المادية للهيئات والمؤسسات العامة، واختتمت الدراسة<br/>بالعديد من النتائج والتوصيات التي تم ذكرها في نهاية الرسالة. الكلمات الدالة المفهوم والماهية - التنظيم القانوني - الرقابة على المؤسسات العامة. |

In an introductory chapter and two divisions, this study has presented an examination of the legal system of the authorities and public institutions, in accordance with the Cooperation Council for the Arab States of the Gulf (G.C.C.) laws. Division one, however, illuminates the characteristics of Authorities and Public Institutions; it clarifies their importance to local legal system being one of G.C.C. mechanisms to administrate public utilities. Division Two, shed light on the similarities and differences, between the studied authorities and public institutions, and other similar social, business, commercial, and trade organizations.<br/>The study discusses in section one, the G.C.C Authorities and Public Institutions legal regulations, founding, and administrating basics. It has also, highlighted their legal system, including the laws organizing their financial transactions, and the one commanding their relation with their employers.<br/>Section two is devoted, to discuss the administrative and judicial surveillance in which the institutions under the study have been submitted to. It contains an examination of the ministerial power over these Authorities and Public Institutions, and an analysis of the Council of Ministers' power over the Authorities and Public Institutions that does not<br/>follow a precise minister.<br/>The study then moved to review the surveillance systems imposed upon the G.C. Authorities and Public Institution; it reviews the main and assistant surveillance bodies. It discusses also, the administrative judicial surveillance onto the G.C.C Authorities and Public Institutions legal and administrative actions. It has explained as well, the cancellation surveillance and the compensation surveillance.<br/>The research ended with a conclusion and a number of findings and recommendations<br/>Semiotic words: Essence and notion Legal systematization Institutions Surveillance. |
