جاءت هذه الرسالة وعنوانها " المركز الدستورى للنيابة العامة " في بابين رئيسيين ، وإنطلاقاً من إشكالية الدراسة المتمثلة في أثر النصوص الدستورية المنظمة لعمل النيابة العامة على القواعد القانونية السارية من ناحية ، وعلى الممارسة اليومية للنيابة العامة فيما يصدر عنها من أعمال من ناحية أخرى تناول الباب الأول الاختصاصات الدستورية للنيابة العامة في الدعوى الجنائية، وخلال هذا الباب تم مناقشة النيابة العامة كسلطة إتهام في الفصل الأول، وتم إستعراض النظام القانوني للنيابة العامة في المبحث الأول منه ، وتناول اختصاص النيابة العامة في تحريك ومباشرة الدعوى الجنائية في المبحث الثاني . وتناولت الدراسة في الفصل الثاني من الباب الأول اختصاص النيابة العامة في مباشرة التحقيق الإبتدائي بين الإنفراد والمشاطرة وقد تناولت الدراسة في هذا الفصل موقف النصوص الدستورية في مصر قبل وبعد 2014 بشأن اختصاص النيابة العامة بمباشرة التحقيق الإبتدائي بين الإنفراد بمباشرة هذا الاختصاص ، والمشاطرة في<br/>مباشرته.<br/>ويأتي الباب الثاني من الدراسة بعنوان الدستور كضابط لإجراءات النيابة العامة الماسة بالحرية الشخصية ويتناول تحليل القواعد الدستورية المقيدة والضابطة للإجراءات الماسة بالحرية الشخصية . وتم تقسيم هذا الباب الثلاثة فصول تناولنا من خلالهم الأصول الدستورية الضابطة لحماية الحرية الشخصية ، فقد جاء الفصل الأول بعنوان أصل البراءة ودعامته حق الدفاع، والفصل الثاني بعنوان مبدأ الشرعية في الإجراءات الجنائية، والفصل الثالث تناولنا فيه الضمان القضائي في الإجراءات الماسة بالحرية الشخصية |

This thesis entitled "The Constitutional Center of the Public Prosecution is divided into two main sections, and based on the problematic of the study represented in the impact of the constitutional texts regulating the work of the Public Prosecution on the legal rules in force on the one hand, and on the daily practice of the Public Prosecution in its actions on the other hand, the firstsection dealt with The constitutional functions of the Public prosecution in criminal lawsuit Prosecution in the criminal case. During this chapter Prosecution as an accusing authority was discussed in the first, by reviewing the legal system of the Public Prosecution, the first section of it, and dealing with the competence of the Public Prosecution tointiatinga criminal cases in the second topic. In the second chapter ofsection One, the study dealt with the competence of the Public Prosecution to conduct the preliminary investigation between unilateralism and sharing<br/>The second section of the study deals with the constitution as an officer of the Public Prosecution's procedures affecting personal freedom, by analyzing the constitutional rules restricting and regulating procedures affecting personal freedom. This sectionhas been divided into three chapters, in which we dealt with the constitutional principles governing the protection of personal freedom. The first chapter is entitled the principle of innocence and its support is the right of defense, the second chapter is entitled the principle of legality in criminal procedures, and the third chapter deals with the judicial guarantee in procedures affecting personal freedom. |
