- إن تقرير مبدأ المسئولية للحكام بعد ضمائة هامة لعدم الخروج على القواعد العامة ، ويحقق<br/>الاستقرار في المجتمع ، كما يؤدى إلى إبعاد غير الأكفاء عن السلطة.<br/>- إن تعريف الحق في الفقه الوضعي و الفقه الإسلامي، يشير باله ميزة أو مصلحة أو سلطة أو مكنة ثابتة للفرد له إرادة للاستئثار والتصرف فيها يقررها القانون له أو للمجتمع أو يقرها<br/>الشارع الحكيم .<br/>- إن طبيعة الحق في المعارضة وما يقتضيه من تقوية دعائم النظام واستمراره والحيلولة من<br/>تعرضه للأزمات التي قد تعصف به من وقت لآخر تحقيقا للقواعد الدستورية والعدالة<br/>الاجتماعية ، تؤدى بدورها إلى أن ينعم من خلالها الرأي العام بالحقوق والحريات<br/>من خلال الحديث عن التطور التاريخي والتكنولوجي للدولة الحديثة وعلاقة ذلك بالحق في<br/>المعارضة يتبين أن الحق في المعارضة قد تطور بعد القرن الثامن عشر تطورا مشهودا حيث لم يعد الحق في المعارضة محل أدنى شك في الأنظمة السياسية إذ أصبح هذا الحق<br/>أركان فكرهم ومحور اهتمامهم وأبحاثهم وكتاباتهم.<br/>- إن التطور التكنولوجي للدولة الحديثة جعل من الصعب على الأنظمة أن تتحكم بصفة مطلقة<br/>على الثوار والمقاومين ولذا أصبح التطور التكنولوجي أداة ضغط على الأنظمة المستبدة<br/>تساعد الثوار على نجاح المعارضة ضدها لتصويب مسارها وتنير لها الطريق لتصحيح الأخطاء بهدف عدم الخروج على القواعد الدستورية . فالمعارضة كاشفة ومصححة ومصوبة<br/>للأخطاء . |

Determining the principle of responsibility for rulers is an important guarantee for not deviating from the general rules, and achieves stability in society, as well as leads to the removal of the incompetent from power.<br/>The definition of the right in positive jurisprudence and Islamic jurisprudence, indicates that it is a feature, interest, authority or a fixed position of the individual who has a will to monopolize and dispose of it, determined by the law for him or for the community, or approved by the wise legislator.<br/>The nature of the right to dissent and what it requires of strengthening the foundations of the system and its continuity and preventing it from being exposed to crises that may afflict it from time to time in order to achieve constitutional rules and social justice, in turn, leads to public opinion enjoying rights and freedoms through it.<br/>By talking about the historical and technological development of the modern state and its relationship to the right to dissent, it is clear that the right to dissent has developed after the eighteenth century with remarkable development, as the right to dissent is no longer under the slightest doubt in political systems, as this right has become the pillars of their thought and the focus of their research, research and writing.<br/>- The technological development of the modern state made it difficult for the regimes to have absolute control over the revolutionaries and the resisters. Therefore, technological development has become a tool of pressure on the tyrannical regimes that helps the revolutionaries to succeed in the opposition against them to correct its course and illuminate the way for it tocorrect mistakes in order not to deviate from the constitutional rules. The opposition is revealing, corrected and corrected for errors. |
