شهدت العقود الإدارية الدولية تطوراً كبيراً في الآونة الأخيرة، في ضوء المتغيرات التي لحقت بهيمنة الدولة على مقدرات العقد الإداري ، وتناولنا الموضوع في قسمين: أولهما: يمثل نظرة عامة على التحكيم في العقود الإدارية الدولية شملت التعريف بماهية العقد الإداري الدولي ومدى إمكانية الاتفاق على التحكيم فيه، مع التركيز على مرحلة تنفيذ أحكام التحكيم الأجنبية<br/>في مصر.<br/>وثانيهما: تناول التحكيم في عقود الامتياز البترولية من حيث طبيعتها القانونية، ومدى إمكانية الاحتجاج بسيادة الدولة وحصانتها القضائية وحصانتها ضد تنفيذ أحكام التحكيم الأجنبية، وكذلك دور التحكيم الدولي في معالجة ظاهرة اختلال التوازن في اتفاقيات البحث عن البترول ومدى إمكانية إعمال<br/>نظرية القوة القاهرة<br/>ومن أهم التوصيات، ضرورة تبنى الدعوة لتعديل اتفاقية نيويورك لتنفيذ أحكام التحكيم الأجنبية بشأن تنظيم الأحكام الوقتية، والمناداة بتعديل المادة (3) من قانون التحكيم المصري لتحديد ضوابط تطبيق معيار دولية النزاع وتعلقه<br/>بالتجارة الدولية. |

Recently, international administrative Contracts have been updated greatly. This is due to changes in stat's domination of the administrative Contract. In this tesis, this topic has been discussed in two parts.<br/>Firstly:<br/>General view on arbitration in administrative Contracts, it's defenition, setling for an arbitration and the execution of foreign arbitration award in EGYPT.<br/>Secondly:<br/>A- Arbitration in administrative Contracts for petroleum Concassion, it's legal nature and governement judical immunity and immunty from enforcement the arbitration award.<br/>B- International arbitration role in addressing the imbalance in the oil research agreements in EGYPT.<br/>Most important recommendations:<br/>Amending New York Convention on execution Foreign arbitration awards, Concerning temporary judgements.<br/>Amending article (3) in the Egyptian arbitration act identify international dispute and it's relation to international trade. |
