قد خصصت هذه الرسالة لدراسة موضوع "أحكام الخبرة في المنازعات الإدارية، دراسة مقارنة" وتتضمن مقدمة وفصل تمهيدي وبابين وخاتمة. وقد أوضحت في المقدمة أهمية الدراسة، والهدف منها، وصعوبتها، ومنهج الدراسة، وإشكالية الدراسة، وخطة الدراسة.<br/>أما الفصل التمهيدي فجاء بعنوان المقصود بالخبير القضائي مشتملاً على تعريف الخبير القضائي، وهذا في المبحث الأول، أما المبحث الثاني، فقد تناولت بيان ماهية المنازعات الإدارية.<br/>من ثم فقد تناولت بعد ذلك في الباب الأول الحديث عن الإطار القانوني الذي يحكم عمل الخبير.<br/>القضائي، وجاء ذلك بمجال الدراسة على فصلين مبين على النحو الآتي -<br/>الفصل الأول: النطاق القانوني للخبرة القضائية<br/>الفصل الثاني: واجبات وحقوق الخبير القضائي<br/>نظراً لدور التحكيم الفعال في مجال المنازعات الإدارية ولأهمية بيان مسؤولية الخبير وكيفية تقدير.<br/>التعويض الناتج عن خطئه قبل المضرورين، وقبل جهة الإدارة.<br/>من أجل هذا فقد خصصت الباب الثاني من هذه الرسالة بعنوان النظام القانوني للخبرة في المنازعات.<br/>الإدارية. وتناولته على فصلين على النحو الآتي:<br/>الفصل الأول: دور التحكيم والخبرة في تسوية المنازعات الإدارية.<br/>الفصل الثاني: أحكام مسؤولية الخبير القضائي.<br/>أخيراً الخاتمة وبيان أهم النتائج وأردفها بالتوصيات والمقترحات. |

This thesis is dedicated to exploring the subject of the provisions of experience in administrative disputes - a comparative study and it includes and introduction introductory topic, two sections and a conclusion.<br/>In the introduction, 1 have explained the importance of the study, it's aim, difficulty and the metrology of the study, the problematic of the study and the study plan.<br/>As for the introductory topic, it's entitled what's intended by judicial expert, including the definition of the judicial expert and this is in the first requirement. As for the second requirement, it dealt with the nature of administrative disputes<br/>Hence, in Chapter One, I have discussed the legal framework governing the work of judicial expert, and this came in the field of the study in two chapters as follows:<br/>- Chapter One: The Legal Scope of Judicial Experience<br/>Chapter Two: Duties and Rights of the Judicial Expert.<br/>Given the role of effective arbitration in the field of administrative disputes and the importance of explaining the expert's responsibility and how to estimate the compensation resulting from bus mistake for the affected and the administration side.<br/>To this end, I have devoted the second chapter of this thesis titled The Legal System of Experience in Administrative Disputes, and dealt with it in two chapters as follows:<br/>-Chapter One: The Role of Arbitration in Settling Administrative Disputes<br/>- Chapter Two: Judicial Expert Responsibility Provisions.<br/>Finally, the conclusion and pointing out the important results and supplemented with recommendations and proposals. |
