أن الأصل في العقود الرضائية أن يكفي تبادل الإرادتين لكي يتم إبرام العقد؛ ولكن هناك بعض العقود التي يشترط المشرع فيها شكلا معينا ؛ حيث يجب أن يتم التعاقد في الشكل الذي حدده القانون؛ وإلا أصبح العقد باطلاً، لا سيما العقود الإدارية التي تكون الجهة الإدارية طرفا فيها؛ ولذلك نص قانون المناقصات والمزايدات رقم (89) لسنة 1998م في المادة (32) من القانون السابق على إجراءات معينة يجب أن يلتزم بها لكتابة العقد الإداري والتوقيع عليه؛ لذلك لا يمكن القول بخلاف ذلك في العقد الإداري الإلكتروني، ولا محل لمخالفة أحكام القانون لكون العقد يتم إبرامه بالوسائط الإلكترونية؛ لذلك في حين إذا تحدثنا عن حجية التوقيع الإلكتروني في القانون المصري؛ نجد أن المادة (14) من القانون رقم (15) لسنة 2004م، للتوقيع الإلكتروني نصت على للتوقيع الإلكتروني في نطاق المعاملات المدنية والتجارية والإدارية ذات الحجية المقررة للتوقيعات في أحكام قانون الإثبات، إذا روعي في إنشائه وإتمامه الشروط المنصوص عليها في هذا القانون، والضوابط الفنية والتقنية التي تحددها اللائحة التنفيذية لهذا القانون)؛ إذا بالنظر إلى هذا النص نجد أنه تناول التوقيع الإلكتروني في نطاق المعاملات الإدارية الإلكترونية الحجية القانونية متى توافرت فيه الشروط، ولم يترك المشرع للقاضي تحديد الأخذ بالحجية القانونية للتوقيع أم لا؛ حيث إنه أقر الحجية<br/>القانونية للتوقيع الإلكتروني متى توافرت فيه الشروط القانونية لصحته.<br/>ولقد ساوى المشرع الفرنسي بين التوقيع الإلكتروني والتوقيع التقليدي من حيث وظيفته في الإثبات في القانون رقم (2000 (230) الصادر في (2000/3/13م)، المادة (1316) من التقنين المدني الفرنسي الحجية القانونية للتوقيع الإلكتروني متى حققت الوظيفة الشروط الخاصة بالتوقيع ولقد أشارت قوانين العقود الإدارية الإلكترونية في فرنسا إلى تطبيق القوانين الخاصة بالقانون المدني في العقود الإدارية الخاصة بالكتابة والتوقيع الإلكتروني المواد رقم (1316-1)، (1316-4) ويمكن أن تطبق في إبرام العقود الإدارية الإلكترونية. وفي المادة (19) من التوجيه الأوروبي للتوقيع الإلكتروني؛ لم تفرق بين أشخاص القانون العام وأشخاص القانون الخاص من حيث الحجية القانونية<br/>للتوقيع الإلكتروني. |
