ترجع أهمية البحث إلى أن معظم نقاط هذا البحث ترتبط بمشاكل كثيرا ما تثار في الواقع العملي فيما يخص دعوى الإلغاء، كما أن البحث قد اقتضى التعمق في نصوص قانونية واجتهادات قضائية في مجال شروط قبول دعوى الإلغاء ما زالت حديثة لم يتطرق لها الباحثون بالبحث والتحليل.<br/>في بعض الأحيان.<br/>كما أن شروط قبول دعوى الإلغاء، والتي لا يخفى على أحد أهميتها يعد توافرها ضرورة ليستطيع القاضي البحث في موضوع الدعوى، كما أنها تتعلق بالنظام العام، وقد طرأ على هذه الشروط العديد من التطورات التشريعية والقضائية، وسيتم في هذا البحث التطرق لهذه الشروط مع التركيز على.<br/>التطورات التي لحقت بها، والتطبيقات القضائية الحديثة التي واكبت هذه التطورات.<br/>وقد اتبعت في دراستي الماثلة بشكل أساسي المنهج التأصيلي والتحليلي، كما اتبعت المنهج المقارن بين القوانين الفرنسي والمصري والسوري، والتي تعد المدارس الأم في مجال القضاء الإداري على وجه العموم، للاستفادة قدر الإمكان من تجارب هذه الأنظمة بخصوص شروط قبول دعوى الإلغاء<br/>وما طرأ عليها من تطورات. |
