تتبلور إشكالية مسئولية البنك العقدية والتقصيرية عند تقديم خدمة المعلومات والاستشارات المصرفية للعملاء ، في كون البنوك هى الطرف القوي في العلاقة التي تجمعها بالعملاء لما تتمع به من قوة اقتصادية وخبرة فنية في تلك العمليات، مما يستوجب محاولة الوصول إلى آلية مناسبة وملائمة ومُحكمة لتنظيم عمليات التزام البنك بتقديم المعلومات والاستشارات المصرفية وصولاً لخدمة العملاء ومساعدتهم في اتخاذ قراراتهم الاستثمارية، مما يتبعه من انتعاش السوق ، مع وضع التدابير الاحترازية والضمانات الوقائية للحدِّ من مخاطر تقديم البنك معلومات ناقصة أو مضللة للعملاء دون ضوابط . بل إن الهدف الرئيس من طلب تقديم المعلومات والاستشارات المصرفية من جانب البنك هو تجنب ما قد يلحق العميل من مخاطر نتيجة اتخاذه قرارًا غير سليم، فيأتي دور البنك لإزالة حالة عدم التأكد عند هذا العميل ؛درءًا للمخاطر التي من الممكن أن تلحق به. ويلتزم البنك بتقديم النصح والمشورة وتبصير العميل خلال المراحل المختلفة التي تمر بها علاقته بالبنك، فيوجد هذا الالتزام عند إبرام العقد ويستمر خلالها، إذ يجب عليه الالتزام بالتبصير والمشورة. |

The problem of the bank's contractual and tortious liability when providing banking information and consulting services to customers is crystallized in the fact that banks are the strong party in the relationship they have with customers due to their economic strength and technical expertise in those operations, which necessitates trying to reach an appropriate, suitable and robust mechanism to regulate the bank's compliance operations. Providing banking information and consultations to serve customers and assist them in making their investment decisions, which will lead to market recovery, while putting in place precautionary measures and preventive guarantees to reduce the risks of the bank providing incomplete or misleading information to customers without controls. Rather, the main goal of requesting the provision of banking information and consultations from the bank is to avoid any risks that may befall the customer as a result of making an incorrect decision, so it is the bank's role to remove the state of uncertainty for this customer, in order to ward off the risks that could befall him. The bank is obligated to provide advice, counsel, and insight to the customer during the various stages of his relationship with the bank. This obligation exists upon concluding the contract and continues throughout it, as he must commit to providing insight and advice. |
