من خلال دراسة عقد مقاولة البناء والأحكام المنظِّمة له، لقد اشترط المشرِّع الليبي في المادة (650) مدني مسئولية كل من المقاول والمهندس المعماري عن الأخطاء التي تقع أثناء تنفيذ الالتزام، وذلك في مواجهة رب العمل باعتباره طرف ضعيف في العقد وجعل مدة الضمان عشرة سنوات من وقوع التهدُّم أو ظهور العيب، فالتسلم من قِبَل رب العمل لا ينتهي بموجبه مسئولية المقاول بل تستمر لمدة عشرة سنوات من تاريخ التسلُّم وثلاثة سنوات من ظهور العيب ولا يستطيع المقاول التخلص من المسئولية إلَّا عن طريق السبب الأجنبي، في ظهور العيب تقوم المسئولية على المقاول وهي قرينة قانونية قاطعة لا يستطيع التخلص منها، وقد افترض المشرع التضامن بين كل من المهندس المعماري والمقاول في مواجهة رب العمل. ويقع التزام على عاتق المقاول وهو تسليم العمل إلى رب العمل حسب المواصفات وكراسة الشروط في العقد خاليًا من أية عيوب وعلى رب العمل إعطاء الأجر إلى المقاول بمجرد تمام التسلُّم من قِبَله بدون تحفُّظ. |

Through the study of the construction contracting contract and the provisions regulating it, the Libyan legislator has stipulated in Article (650) civil the responsibility of both the contractor and the architect for errors that occur during the implementation of the obligation, in the face of the employer as a weak party to the contract and make the warranty period ten years from the occurrence of the demolition or the appearance of the defect, the receipt by the employer does not end under which the contractor's responsibility does not end, but continues for a period of ten years from the date of receipt and three years from the appearance of the defect The contractor can only get rid of liability through the foreign cause, in the appearance of the defect, the responsibility is based on the contractor, which is a conclusive legal presumption that he cannot get rid of, and the legislator has assumed solidarity between both the architect and the contractor in the face of the employer. The contractor has an obligation to deliver the work to the employer according to the specifications and the specifications in the contract free of any defects, and the employer must give the wage to the contractor as soon as it is received by him without reservation. |
