| Summary, etc. | ان دراسة موضوع النظام القانوني للهيئات المستقلة في العراق دراسة مقارنة .ابرز اهمية هذا النظام وبالخصوص في المجال الاقتصادي والاجتماعي والمالي والاداري وحماية الحقوق والحريات العامة وفق معايير الفعالية والنجاعة بما يكفل حماية النظام العام وحماية المصلحة العامة للدولة في مواجهة التحديات الداخلية والازمات الاقتصادية والمالية ، كون ان هذا النظام يسمح بتحقيق التوزان بما يضمن تحقيق الأهداف التي انشات من اجلها تلك الهيئات .ان تسليط الضوء على النظام القانوني للهيئات المستقلة في العراق يعدم وضوح رؤية وموقف المشرع العراقي منه بالنسبة للتشريعات المقارنة بالرغم من محاولته ارساء نظام قانوني جدبد بعيدا عن النهج التقليدي ،غير ان عدم توفر استقلالية حقيقة سواء تعلق الامر بالجانب العضوي لهذه الهيئات او الجانب الوظيفي وخلو النصوص الدستورية الخاصة بالهيئات من الاشارة الى الاستقلال الفني شأنه شأن الاستقلال المالي والاداري تحسب على المشرع العراقي ، بالشكل الذي يؤدي الى طرح سؤال عن ماهية النظام القانوني لتلك الهيئات والهدف الذي يكمن وراء انشاء هذه الهيئات ومنحها كل تلك السلطات وتردد طبيعتها القانونية. |

| Summary, etc. | The study of the subject of the legal system of independent bodies in Iraq is a comparative study. It highlights the importance of this system, especially in the economic, social, financial and administrative fields, and the protection of public rights and freedoms according to the standards of effectiveness and efficiency in order to ensure the protection of public order and the protection of the public interest of the state in the face of internal challenges and economic and financial crises, since this system allows achieving balance to ensure the achievement of the goals for which these bodies were established. The shedding light on the legal system of independent bodies in Iraq blurs the clarity of the vision and position of the Iraqi legislator regarding comparative legislation, despite attempts This is the establishment of a new legal system away from the traditional approach. However, the lack of true independence, whether it is related to the organic side of these bodies or the functional side, and the absence of the constitutional texts of the bodies from referring to technical independence, such as financial and administrative independence, is calculated on the Iraqi legislator. In a way that leads to a question about what the legal system of these bodies is and the purpose behind establishing these bodies and granting them all those powers and echoing their legal nature. |
