تناولت الدراسة موضوع " المركز القانوني للقاصر" وجاءت في مقدمة وفصل تمهيدي وقسمين وخاتمة، وبينت مدى اهتمام المشرع المصري والفقه الإسلامي برعاية القاصر وحفظه والإشراف على جميع الأمور المتعلقة بنفسه وشئونه الشخصية، كالطعام والشراب واللباس، والتعليم والتأديب والتزويج، ونحوهم، من خلال نظام الولاية على النفس، وكذلك الاهتمام برعاية مال القاصر والعمل على حفظه وتنميته واستثماره فيما يعود عليه بالنفع ويحقق له المصلحة من خلال نظام الولاية على المال، كما علقت الدراسة على مشروع قانون الأحوال الشخصية المصري الجديد المعد سنة 2022، والذي لم يصدر حتى الآن؛ حتى تتناول النصوص والأحكام الواردة فيها في أحدث صورها حتى قبل صدورها، وكذلك بينت الدراسة مدى الأهلية التي يتمتع بها القاصر في القانون المصري والفقه الإسلامي منذ ولادته وإلى حين بلوغه ورشده، كما بينت حكم عقوده وتصرفاته المالية، ومدى مسئوليته عنها، وبينت كذلك حكم أفعاله الضارة بالغير، ومدى مسئوليته عنها وإلزامه بتعويض الغير عما أصابه من ضرر بسببها. وأخيرًا انتهت الدراسة إلى بعض التوصيات التي تقدم حلولًا عملية لبعض المشكلات المترتبة على وجود القاصر في مركز قانوني قلق بعد انفصال والديه، خاصة في مجال سن الحضانة ومسكن الحضانة وحق الرؤية والاستضافة والولاية على النفس وحق النفقة والولاية التعليمية وغيرها من المسائل الشائكة في هذا الصدد، والمثارة عادة أمام المحاكم المصرية، كما انتهت الدراسة كذلك إلى بعض التوصيات في مجال الأهلية والولاية على المال ومسئولية القاصر المدنية والجنائية، كالمناداة بالتقليل من القيود المفروضة على سلطات الولي في الولاية على المال، والأخذ بفكرة العقد الموقوف، وحماية القاصر من الغبن الفاحش في التصرفات الدائرة بين النفع والضرر، والأخذ بمبدأ المسئولية الكاملة للقاصر غير المميز عن عمله غير المشروع، والنزول بسن الأهلية لتحمل العقاب الجنائي، وكل ذلك بهدف تحقيق العدالة واستقرار المعاملات. |

The study addressed the topic of "the legal status of minor" and included an introduction, a preliminary chapter, two main sections, and a conclusion. It highlighted the interest of the Egyptian legislator and Islamic jurisprudence in the care and protection of minor, supervising all matters related to their personal affairs such as food, drink, clothing, education, discipline, and marriage, through the system of guardianship (wilayah). The study also discussed the importance of protecting the minor's property, preserving it, and investing it in a way that benefits them through the system of guardianship over property (wilayah al-mal). The study also commented on the new Egyptian Personal Status Law project, which has not been issued yet, to discuss its provisions and regulations in their latest form before its issuance. Furthermore, the study explained the legal capacity enjoyed by minor in Egyptian law and Islamic jurisprudence since birth until they reach adulthood. It also discussed the validity of his contracts and financial transactions, his responsibility for them, and his liability for harmful acts committed by him and the obligation to compensate the affected party. Finally, the study provided practical recommendations to address some of the problems that arise when minor is in a legal position of concern after his parents' separation, especially in the areas of custody, visitation rights, guardianship, maintenance, education, and other related issues. The study also made recommendations in the areas of legal capacity, guardianship over property, civil and criminal liability of minor, such as reducing the restrictions imposed on the guardianship over property, adopting the idea of suspended contracts, protecting minor from gross injustice in transactions between benefit and harm, holding minor fully liable for their illegal actions, and lowering the age of criminal responsibility. The ultimate goal of these recommendations is to achieve justice and stability in transactions. |
