مع بداية انتشار شبكة المعلومات الدولية؛ لم يكنْ هناك قلقٌ من الجرائم التي يمكن أن تُرتكب على الشبكة المعلوماتية، وذلك نظرًا إلى استخدامها المحدود. ولكن مع بزوغ فجر الثورة المعلوماتية، وتوسع استخدام شبكة الإنترنت، وبدء استخدامها في المعاملات التجارية، ودخول جميع فئات المجتمع إلى قائمة المستخدمين؛ ظهرت جرائمُ الشبكة المعلوماتية، وقد تزايدت بمرور الوقت، وتعددت صورُها وأشكالُها، وأُطلق عليها الجرائم المعلوماتية؛ أي تلك الأعمال والأفعال المجرَّمة التي تتم عن طريق شبكة المعلومات الدولية، وتُعدُّ من أهمِّ التحديات وأخطر الجرائم التي تواجه دول العالم في عصرنا الحاضر. وانطلاقًا من ذلك؛ فإن التقنيةَ المعلوماتية والاتصالات تعدُّ من الوسائل التقنية التي تتطور باستمرارٍ، وبخاصةٍ حينما يتطلب الأمرُ البحثَ في الكيفية التي اُرْتُكِبَت بها الجريمة، ومعرفة مرتكبيها، ومواجهة الجرائم المعلوماتية التي تقع على الحاسوب الآلي والشبكة المعلوماتية، فضلًا عن الفجوة الرقمية بين الدول، ومدى كفاءة هذه الدول وتعاونهم فيما بينهم حيال التعامل مع تكنولوجيا المعلومات؛ إذ لا يكفي وجودُ قانونٍ للتجريم والعقاب، أو وضعُ قواعدَ تتعلق بالتعامل مع الشبكة المعلوماتية ووسائل تقنية المعلومات من الناحية الموضوعية؛ بل يلزم - لكي يتحقق لهذا القانون فعاليته - تنظيمُ إجراءاتٍ جنائيةٍ معينةٍ لمكافحة هذا النوع من الإجرام؛ فالجرائم التي تقع على الحاسوب الآلي والشبكة المعلوماتية جعلت المشرعَ الجنائي يعيد النظرَ في كثيرٍ من القواعد الموضوعية والإجرائية الجزائية التقليدية؛ لتحديد المسئول عنها، وإنزال العقوبة أو التدابير الاحترازية به، من خلال النشاط الذي تقوم به أجهزة العدالة الجنائية في كشف غموضها، ويحدد هذا النشاطُ - من حيث السبب - المسئولَ عن ارتكابها، أما من حيث الغاية فإنزال العقوبة أو التدابير الاحترازية التي يقرر القانونُ إنزالها بمن أُسندت إليه. |
