في ظل التوجه نحو الرقمنة المالية الشاملة تعتبر المقومات المالية هي النواة الاقتصادية والقاعدة التي سيقوم عليها هيكل القطاع المالي والنظام الاقتصادي الرقمي الحديث، الذي لا يعتمد على النقد والأوراق والائتمان، لكن يقوم على المقومات والرقمنة ونظم تمويل إدارة الأصول وحوزتها عبر آلياتها العقدية والناقلات المالية الإسلامية. وتظهر أهمية موضوع البحث نظرا لاحتياج السوق المالي إلى آليات مالية شرعية تلائم عصر التحول الاقتصادي الرقمي والرقمنة المالية الشاملة والذكاء الاصطناعي، والبحث عن حلول لضعف هياكل القطاع المالي ولعلاج الاقتصاد المتأزم. واستهدفت من هذا البحث التأصيل الفقهي لمنظومة التحول المالي للأصول المادية إلى مقومات مالية ورقمية، وآلياتها الجديدة وهي عقد إدارة المقومات المالية وعقد الحوزة على المقومات، وعقد إدارة المقومات المالية المقترن بالحوزة أو الاندماج، والناقلات المالية وأهمها الصكوك الإدارية، وتطبيقاتهم العملية كأدوات للسياسات الاقتصادية. ومن أهم النتائج التي أسفر عنها هذا البحث: أولا: مبدأ ضمان المديرين لنتائج الإدارة، ثانيا : أن الآليات والناقلات التمويلية والاستثمارية هي عقود شرعية، ثالثا: أنها من أدوات السياسة النقدية للتحكم وتوجيه النشاط الاقتصادي وإصلاح الاقتصاد المتأزم. ومن أهم التوصيات التي أوصي بها الباحث: ضرورة تقنين عقود الإدارة والحوزة والصكوك الإدارية كأدوات مالية ضمن الأدوات المالية في سوق النقد والائتمان وسوق المال، كما يجب الإسراع بالتحول من سياسات الفائدة الربوية ومشتقاتها التضخمية إلى سياسات وآليات عقود المشاركات والمعاوضات والإدارة والحوزة والناقلات التمويلية والاستثمارية، خاصة الصكوك الإسلامية المالية والإدارية. |

In light of the trend towards comprehensive financial digitization, financial evaluators are considered the economic nucleus and the basis on which the structure of the financial sector and the modern digital economic system will be based, which does not depend on cash, papers and credit, but is based on evaluators, digitization and financing systems for managing and holding assets through its contractual mechanisms and Islamic financial carriers.<br/>The importance of the research topic appears due to the financial market's need for legitimate financial mechanisms that are suitable for the era of digital economic transformation, comprehensive financial digitization and artificial intelligence, and the search for solutions to the weak structures of the financial sector and to treat the crisis economy.<br/>Among the most important results of this research are: First: the principle of guaranteeing managers for the results of management, second: that financing and investment mechanisms and carriers are legitimate contracts, third: that they are among the monetary policy tools to control and direct economic activity and reform the crisis economy<br/>Among the most important recommendations recommended by the researcher: the need to codify management and estate contracts and administrative instruments(sukuk) as financial instruments within the financial instruments in the cash, credit and money market, and the shift must be accelerated from usurious interest policies and their inflationary derivatives to the policies and mechanisms of partnership and netting contracts, management and estate, and financing and investment carriers, especially Islamic financial and administrative instruments. |
