| Summary, etc. | أضحى التحكيم القضاء المفضل باعتباره طريقاً لفض المنازعات سواء على المستوى المحلى والإقليمى أو على المستوى الدولى، حيث يشعر المتنازعون أنه وليد إرادتهم ويتجاوب مع مصالحهم المشتركة؛ نتيجة لطول إجراءات التقاضى، والبطء الشديد في الفصل في المنازعات المعروضة على القضاء، كما أنه يسمح لأطرافه بوضع إجراءات التسوية على نحو يناسبهم، فضلا عن اختيار القانون واجب التطبيق على موضوع النزاع؛ ولهذا فإن وجود نظام للتحكيم في دولة ما، يكفل المزايا المذكورة، ويعد عاملا من عوامل جذب الاستثمارات والشركات الأجنبية إلى إقليمها. جاء البحث مقسما إلى بابين يسبقهما فصل تمهيدي، بعنوان ماهية اتفاق التحكيم وذلك من خلال ثلاثة مباحث: المبحث الأول تحت عنوان "ماهية التحكيم وصوره."، وتناولنا في المبحث الثاني: "التمييز بين التحكيم وما يتشابه معه والمعايير المميزة له. أما المبحث الثالث فقد جاء بعنوان: "مزايا وعيوب التحكيم". لينتهي الفصل التمهيدي من وضع اللبنات الأولى في جدار هذا البحث . وقد انتقلت الدراسة إلى الباب الأول والذى تم من خلاله بيان انعقاد اتفاق التحكيم. فاحتوى فصله الأول على شروط صحة اتفاق التحكيم وآثاره. "أما الفصل الثاني فقد تناولنا فيه" اتفاق التحكيم وأثره على مبادئ الخصومة " ثم جيء بالباب الثاني من الدراسة تحت عنوان " حكم التحكيم "بوصفه الثمرة التي يتوق إليها أطراف النزاع وتحقيقا للفائدة المرجوة من الدراسة تم معالجة الموضوع من خلال فصلين: الفصل الأول بعنوان: "كيفيه إصدار حكم التحكيم وحجيته وكيفية تنفيذه"، أما الفصل الثاني فقد جاء بعنوان : "دعوى بطلان حكم التحكيم". وجاءت خاتمة البحث لتشمل أهم النتائج والتوصيات التي توصل إليها الباحث. |

| Summary, etc. | Arbitration has become the preferred judiciary as a way to resolve disputes, whether at the local, regional or international level, as the disputants feel that it is born of their will and responds to their common interests. As a result of the lengthy litigation procedures, and the extreme slowness in adjudicating disputes brought before the judiciary, it also allows its parties to set settlement procedures in a manner that suits them, as well as choosing the law applicable to the subject matter of the dispute; For this reason, the existence of an arbitration system in a country guarantees the aforementioned advantages and is a factor in attracting foreign investments and companies to its territory.<br/>The research was divided into two chapters, preceded by an introductory chapter, entitled What is the Arbitration Agreement, through three subjects: The first subject is titled "What is Arbitration and Its Forms." In the second 1 subject, we dealt with: "distinguishing between arbitration and what is similar to it, and the criteria that distinguish it." The third subject was entitled: 'Advantages and Disadvantages of Arbitration. To finish the introductory chapter laying the first building blocks in the wall of this research. The study moved to the first chapter, through which the conclusion of the arbitration agreement was explained. Its first chapter contained the conditions for the validity of the arbitration agreement and its effects. As for the second chapter, we dealt with "the arbitration agreement and its impact on the principles of litigation."<br/>Then came the second chapter of the study under the title "Arbitration Judgment" as the fruit that the parties to the dispute yearn for, and in order to achieve the desired benefit from the study, the subject was dealt with through two chapters: Entitled: 'Action to invalidate the arbitral award". The conclusion of the research included the most important findings and recommendations that the researcher reached |
