موضوع الرسالة هو دراسة تحليلية مقارنة لنصوص قانون مكافحة جرائم تقنية المعلومات ولائحته التنفيذية من الناحية الموضوعية، بهدف التعرف على أهم المميزات التي تضمنها هذا القانون، والتوصل الى أوجه النقص والقصور التي شابت نصوصه بالمقارنة بالنصوص والقوانين المقارنة الصادرة في ذات الشأن، وذلك من خلال تناول أهم جرائم التعدي على الأنظمة المعلوماتية والجرائم المرتكبة بواسطتها، ودراسة المسئولية الجنائية لوسطاء تقديم خدمات الإنترنت من ناحية إشكالية مقدمي خدمات الإنترنت، سواء كان شخص طبيعي أو اعتباري، بدءا من مورد منافذ الدخول إلى الإنترنت، ومروراً بمقدم خدمات الاستضافة على الانترنت، وكذلك مقدم خدمات سحابة الكمبيوتر، ويتميز دورهم بأنه دور تقني له أهمية في تحديد مسئولية وسطاء مقدمي الخدمات المعلوماتية عبر شبكة الإنترنت، وكذا التعرف على أهم الأسس والضوابط المتعلقة بالتعاون الدولي في مجال مكافحة جرائم تقنية المعلومات، والنظر فيما إذا كانت هذه التشريعات موفقه وكافية من عدمه، ومدي توافقها مع المعاهدات والاتفاقيات الدولية التي أبرمت في هذا الشأن. |
