تكمن أهمية الرسالة في تحديد أحكام المسئولية المدنية عن الأضرار التي تسببها الطائرات على سطح الأرض، حيث تشعبت الآراء التي طرحت بشأن الأساس القانوني لهذه المسئولية وطبيعتها، حيث تختلف طبيعة هذه المسئولية من نظام لآخر، والمشكلة الأخرى هي أنه في بعض الدول لا يوجد تشريع خاص يحكم ويحدد قواعد هذه المسئولية، لذلك فهي تلجأ إلى تطبيق القواعد العامة في المسئولية على هذا النوع من الأضرار، وهذا ما يتنافى مع طبيعة هذه الأضرار المتولدة ، حيث إنها تتميز بخصوصية وتحاط بمخاطر تختلف عن باقي وسائل النقل الأخرى. كما تكمن المشكلة أيضًا في صعوبة إثبات مسئولية الناقل الجوي عن الضرر الحاصل، مما يضع عبئًا ثقيلًا على المضرور طالب التعويض في إثبات مسئولية الناقل، ويحتاج هذا الإثبات إلى جهد ونفقات وتكنولوجيا عالية ومتخصصة ؛ لأنه أمر فني وعلى درجة عالية من التعقيد، وقد انعكس هذا الاختلاف والتباين في تحديد طبيعة وأساس هذه المسئولية في إطار التشريعات الوطنية وفي إطار الاتفاقيات الدولية. فضلا عن تفاقم الأضرار التي تلحق سطح الأرض من جراء حوادث الطائرات واتساع نطاقها والمخاطر التي تحيط بهذا المجال، حتى إنها توصف بالكوارث الجوية، فوقوع حادث واحد في النقل الجوي قد يؤدي إلى خسائر في الطائرة والأرواح تودي بحياة كل من على متنها الركاب والطاقم ، وبذلك فإن اتساع حجم هذه الأضرار في حادث واحد قد تؤدي إلى إفلاس شركة الطيران، وقد تؤدي إلى عزوف شركات الطيران عن ممارسة هذا النشاط والتقييد في تقديم هذه الخدمة، ومن هنا تعرضنا إلى إشكالية البحث والاجتهاد في تقديم وسائل وحلول تعمل على تحقيق هدف المسئولية المدنية وهي الوفاء بالالتزام بالتعويض لجبر الضرر حال إعسار الناقل الجوي أو عدم قدرته على الوفاء بالالتزام بالتعويض المقدر؛ وذلك لاتساع مجال هذا الضرر، أو عندما يكون سبب الحادث مجهولًا. |
