لمتشهد البشرية خلال تاريخها الطويل تغيرات في أسلوب الحياة بالعمق والشمول والسرعة، التي تشهدها المجتمعات المعاصرة، منذ أن دخلت التقنيات الحديثة للمعلومات والاتصال في حياتها، من حيث إن التقنيات في كثير من المجالات، ومن أبرزها مجال التجارة، ومن أبرز هذه التقنيات التوقيع الإلكتروني،وكانذلكالدافعوراءتناولهذاالموضوع. حيثإن الطبيعة المعلوماتية في إبرام العقود والصفقات وإدارة المفاوضات التجارية، التي تشكل التجارة الإلكترونية لأنظمتها المختلفة وأساليبها المتعددة أبرز ملامحها، أدى إلى القيام بالكثير من الأعمال، التي كان يستحيل إنجازها من قبل، حيث قدمت هذه التقنية في مجال المواصلات الإلكترونية . وتُعد شبكات المعلومات ونظم التبادل الإلكتروني للبيانات تطبيقًا للاستخدام التكنولوجي الحديث في مجال الاتصالات ونقل المعلومات، فلم يعد هناك مجال لأي دولة تريد أن تواكب العصر حيث إن المعاملات التي تتم بواسطة الوسائل الإلكترونية تتميز بإيجابيات جمة، تتمثل في سهولة إنجاز العملية التجارية بأقل وقت وجهد وتكلفة، فقد أصبح بمقدور المتعاملين عبر الإنترنت إبرام العقود المختلفة بأسرع وقت ممكن وتنفيذها إلكترونيًا بصورة فورية، لا سيما فيما يتعلق بالوفاء عن طريق بطاقة الائتمان، أو الشيك الإلكتروني، أو التحويل الإلكتروني للأموال، وعقد الصفقات التجارية، وغيرها من الوسائل، كما أن التعامل عن طريق الوسائط الإلكترونية أدى إلى ظهور بديل للتوقيع الكتابي (التقليدي)،ألا وهو التوقيع الإلكتروني، حيث إن التوقيع الإلكتروني يسهل على التجار إنجاز أعمالهم التجارية بسرعة، وهذه الأهمية للتوقيع الإلكتروني دفعتالمشرعينلوضع حلولٍ لمختلف المشاكل، التي تفرزها التطورات جراء استعمال التوقيع الإلكتروني، وعلى رأسها: مسألة الإثبات؛ حيث يبدو جليًا أن المشكلة الحقيقية في مجال المعاملاتالإلكترونية تكمن في مدى حجية المحررات الإلكترونية في الإثبات. |

Humanity has not witnessed during its long history the changes in the way of life in depth, comprehensiveness and speed that contemporary societies are witnessing, since modern information and communication technologies entered their lives, in terms of technologies in many fields, the most prominent of which is the field of trade, and the most prominent of these technologies is electronic signature. That was the motivation behind dealing with this topic. Whereas, the informational nature of concluding contracts and deals and managing commercial negotiations, which constitute electronic commerce for its various systems and its multiple methods, its most prominent features, has led to doing a lot of work, which was impossible to accomplish before, as this technology was introduced in the field of electronic transportation. Information networks and electronic data interchange systems are an application of modern technological use in the field of communication and information transfer. There is no longer any room for any country that wants to keep pace with the times. As the transactions that are carried out by electronic means are characterized by many advantages, which are the ease of completing the business process with the least time, effort and cost. Online dealers have become able to conclude various contracts as quickly as possible and implement them electronically in an instant, especially with regard to credit card fulfillment, Or electronic check, or electronic transfer of funds, concluding commercial deals, and other means, and dealing through electronic means has led to the emergence of an alternative to the (traditional) written signature, which is the electronic signature, as the electronic signature facilitates the merchants to complete their business quickly And this importance of the electronic signature has pushed the legislators to develop solutions to the various problems that developments arise from the use of the electronic signature, on top of which is the issue of proof; where it seems clear that the real problem in the field of electronic transactions lies in the authenticity of electronic documents in evidence. |
