تمثل الصورة الشخصية تجسيدًا لشكل معين على شىٔ ثابت كالورق أو الخشب ونحوهما بحيث يثبت منظر الشكل كما تم تجسيده إبتداءً، ويمكن القيام بهذا العمل بوسائل متعدده كالرسم والنقش وعمل التماثيل او بإستخدام الوسائل الالية مثل الكاميرا العادية او الفيديوية وغيرها من الالات التي تستخدم في التصوير ويشمل مفهوم الصورة فضلا عن الصورة الفوتوغرافية او المرسومة باليد او النحت ، الصورة المتحركة التي يتم أخذها وتظهر بعده وسائل منها السينما او التليفزيون او الشبكة العنكبوتية . أما الحق في الصورة فيتمثل في سلطة الإعتراض على إلتقاط الصورة الشخصية أو نشرها فمجرد الإلتقاط او النشر يكون إعتداء على هذا الحق . بدأ الإعتراف بالحق في الصورة الشخصية من قبل القضاء الفرنسي إذ أخذ علي عاتقه حمايه هذا الحق على الرغم من عدم وجود النصوص القانونية التي تنظم هذا الحق وإستمر هذا الوضع الى أن تدخل المشرع فى بعض الدول ونص على حمايه بعض جوانب هذا الحق أما المشرع المصرى فلم ينص علي حمايه هذا الحق ولم ينظمه بنصوص خاصة تكفل حمايته. ويعد الحق في الصورة الشخصية ذا طبيعة خاصة فعلي الرغم من إختلاف الفقهاء حول الطبيعة القانونية لهذا الحق وظهور عده إتجاهات قانونية في هذا المجال إلا أننا وجدنا أنها جميعا لا تعطي الوصف الدقيق لهذا الحق و ذلك لأن هذه الإتجاهات قد أهملت الجانب المالي لهذا الحق الذي يمثل في الوقت الحاضر أهميه كبيرة وقيمة مالية كبيرة لا يمكن تجاهلها ونتيجة لهذه الطبيعة الخاصة فإن الحق في الصورة الشخصية يتميز بخصائص معينة هي قابليته للتصرف والإنابة والإنتقال بالإرث والتقادم في جانبه المالي فقط . و يتم المساس بهذا الحق بصور عدة فالإلتقاط سواء في المكان الخاص أو العام يعد مساسًا بالحق في الصورة الشخصية ومن صور المساس بهذا الحق النشر سواء كان لأغراض تجارية أو لأغراض غير تجارية وفضلا على ذلك فان أعمال المونتاج والكاريكاتير قد تعد في بعض الحالات مساسًا بالحق في الصورة الشخصية إذا ما خرجت عن الحدود المرسومة لها. ولا يعد الحق في الصورة الشخصية من الحقوق المطلقة التي لا ترد عليها أي إستثناءات وإنما هناك إستثناءات على هذا الحق تتمثل في القيود التي ترد على الحق في الصورة الشخصية وتعد هذه القيود في الأصل مساس بهذا الحق إلا انها لضرورات معينة تعد إستثناء من عدم جواز المساس بهذا الحق مما يعطى لهذه الأعمال صفه المشروعية وهذه القيود قد تكون صادرة من الشخص صاحب الصورة نفسه وقد تقضيها المصلحة العامة. أما الحماية المدنية لهذا الحق فأنها تتم بوسيلتين الأولى هي الوسيلة الوقائية التي تتمثل في المطالبة بمنع الإعتداء الواقع على الحق في الصورة او وقفه و هذه الوسيلة يمكن الإستفادة منها عن طريق المزايا التي يوفرها القضاء المستعجل عن طريق تطبيقه لهذه الوسيلة . أما الوسيلة الثانية لحماية الحق في الصورة فهي الوسيلة العلاجية التي تتمثل في التعويض عن المساس بهذا الحق والذي يمكن المطالبة به وفقا للقواعد العامة في المسئولية المدنية. |

Personal image is an embodiment for an object on a concrete thing (such as paper or wood) . Such a job can be done by means of painting, engraving and sculpting on the one hand, and by mechanical means such as photographic camera, video camera or other mechanical means that are used in picturing the concept of image , in addition to photographic picture, drawing and sculpting, includes animating picture that is shown by several means such as Web sites . The right in the image is represented in the authority of objecting against taking pictures or publishing the personal image. Taking picture or publishing it is considered as an assault against this right. The right of personal image was acknowledged by the French Judiciary; that it took on its own protecting this right though there are no legal texts that organize the situation of this right. This situation went on till the interference of the legislator in some countries and provided for protecting some of its aspects. As for Egyption legislator, he did not refer to protecting this right and did not organize special regulations that ensure its protection. The right of the personal image has a special nature. Though the disagreements of jurisprudents about the legal nature of this right, and the emergence of many legal trends in this field; but we think that all of them do not give an accurate description of this right, because these trends has neglected the financial aspect of this right which represents a great importance and has a grate financial value. For this special nature; the right of personal image is characterized by distinctive features such as its ability to be disposed of, writ, inheritance, and prescription in its financial aspect only. The lesion of this right can be performed differently. For example, taking a pictures, whether in private places or public ones can be considered as a sort of damage to the right of the personal image. Among the forms of damaging this right is publishing, whether it is for commercial and non-commercial purposes. In addition. Acts of montage and caricature and deep fake might be considered in some cases as a damage in the right of personal image if they went far after the aim the are edited for. |
