يمكننا أن نخلص من هذه الدراسة - وبكل اطمئنان- إلى أن عمل هيئة التحكيم الاختياري له الطبيعة القضائية دون أدنى شك، وبكل معنى الكلمة؛ وذلك بالنظر إلى أنه عمل يفصل في نزاع ويتمتع بحجية الأمر المقضي، ويقبل التنفيذ الجبري، بل ولا يقبل الطعن فيه بغير طريق، باستثناء دعوى البطلان، هذا فضلًا عن وصف المشرع المصري له- من خلال نصوص قانون التحكـيم - وبشكل صريح فإنه حكم، أضف إلى ذلك أن الإجراءات التي تمر من خلالها أعمال هيئة التحكـيم والتي تسفر عن الثمرة النهائية وهي الحكم الصادر في القضية التحكيمية، كل هذه الإجراءات هي ذاتها الإجراءات المتبعة في ساحات القضاء والتي تُسفر أيضا عن الحكم الفاصل في القضية. |
