تبحث الرِّسالة التزامات جِهات التَّصديق الإلكتروني والمسئوليَّة المَدنيَّة(العقديَّة والتَّقصيريَّة) النَّاشئة عن الإخلال بها في كلٍّ مِن التشريع المِصري والفَرنسي والتُونسي، وأثناء بحث هذه الموضوعات تُناقِش الرِّسالة التَّعريف بجِهة التَّصديق الإلكتروني وكيانها القانوني وطبيعة الخِدمات التى تُقدمها للجمهور، وتكييف العقد الذي يربطها بعملائها، ودعوى المسئوليَّة التي يُقيمها العميل المتعاقد معها والغير البعيد عن هذا العقد إذا أصابه ضرر مِن أعمالها، ومدي استفادة الغير البعيد عن عقد التصديق مِنه، وتبحث الرِّسالة أيضًا موضوع المحكمة المُختصة بنظر هذه الدعوى، وآثار قيام المسئولية في حقها اذا توافرت عناصرها، والتزامها بتعويض أي ضرر تتسبب في وقوعه، والمعيار المُتَّبَع كأساس تقدير مبلغ التعويض، فضلاً عن التزامها بالتأمين من مسئوليتها المدنية كضمان حصول المضرور على حقه في التعويض المناسب إذا ثبت انشغال ذمتها به. |
