إن شركات تداول الأوراق المالية محكومة بقواعد قانونية و لوائح منظمة يتم فيها التعامُل بأنواع متعددة من التعاملات و ليست مقتصرة على تعامل البيع و الشراء بالأسهم و السندات فحسب، و إذا كان هذا هو الغالب فإن هناك -على الرغم من ذلك - أدوات أخرى من التعاملات فى القانون رقم 146 لسنة 1988م، كما أن هناك أوراقًا مالية أخرى قد استحدثت بموجب القانون رقم 95 لسنة 1992م و هى وثائق استثمارية، و قد صدر القانون الجديد باسم: "الصكوك للأوراق المالية" فى القانون رقم 17 لسنة 2018م. و مما لا شكَّ فيه أنَّه لا يخلو أى مجال من مجالات الاستثمار من المخاطر، و هذه المخاطر يجب على صاحب رأس المال أن يضع فى حسبانه توقع حدوثها، كما يمكن القولُ إنه ليست كل المخاطر قابلة للتأمين؛ بل يجب أن تتوافر فيها شروط معينة - كما أسلفنا القول فى ذلك - و قد ترجع مخاطر الاستثمار فى تداول الأوراق المالية إلى عدة أنواع؛ فمنها مخاطر أساسية تتواجد فى جميع أنواع الاستثمار و قد تتعلق هذه المخاطر بالسوق، و قد ترجع هذه المخاطر للتضخم أو للسيولة. كما أن دراسة العائد و المخاطر هى من أهم المتغيِّرات التى يلجأ المستثمر لدراستها قبل الخوض أو الدخول فى أى عملية استثمارية؛ إذ إن المستثمر غالبًا ما يلجأ إلى الاستثمارات التى تحقق له أكبر عائد بأقل مخاطرة؛ و مِن ثَمَّ فهو يقوم بدراسة العائد و مخاطر الاستثمار و ذلك قبل اتخاذ القرار بالدخول فى شركات تداول الأوراق المالية، و فى سبيل ذلك يقوم صاحب رأس المال - حرْصًا على توفير الحماية الفعَّالة لرأس ماله - باللجوء إلى التأمين من المخاطر التى قد تنتج عن دخوله فى عمليات تداول الأوراق المالية. |
