إن الآثار الوخيمة للعقوبات السالبة للحرية قصيرة المدة، وعدم تحقيقها للأهداف المرجوة منها، كانت محط اهتمام المجتمع الدولي بأسره. وقد تجلى هذا الاهتمام في عقد مؤتمرات ولقاءات دولية وإقليمية للبحث في بدائل عقابية أكثر جدوى، وأقل ضررًا. سارت على هذا الأساس، بدائل العقوبات السالبة للحرية قصيرة المدة من ضمن أهم الوسائل العقابية المستحدثة لمواكبة التطور في الفكر العقابي، وغرضها الأساسي تحقيق أهداف<br/>العقوبات السالبة للحرية قصيرة المدة مع تجنب مساوئها.<br/>تمثلت العقوبات، قديمًا، في الإيلام البدني الذي كان يتسم بالقسوة للانتقام من الجاني. وفي بداية القرن الثامن عشر، ظهرت العقوبات السالبة للحرية قصيرة المدة والتي اتخذت من الحرية محلاً لانزال العقوبة بدلاً من البدن. واختلفت الفلسفة العقابية الحديثة عن<br/>سابقتها، فأصبح الهدف من العقوبة اصلاح وتأهيل المجرم بدلاً من إيلامه.<br/>في المقابل؛ ومع الافراط في استخدام العقوبات السالبة للحرية قصيرة المدة، ظهر عنها عدة سلبيات، وأخفقت كثيرًا في بلوغ أهم الأهداف الإصلاحية والتأهيلية للمحكوم<br/>عليهم.<br/>وبناء على ما تقدم؛ فقد ألحت الضرورة على البحث عن بدائل عقابية تتماشى مع الأهداف المحمودة المرجوة من تلك العقوبات بدائل مقيدة للحرية وغير مقيدة لها.<br/>وفق ما سبق، فإذا كان الهدف من العقوبة السالبة للحرية قصيرة المدة بصفة عامة<br/>هو تحقيق النفع للمجتمع، فإن استخدام البدائل العقابية يتطلب الجمع بين تحقيق غايات<br/>العقوبة السالبة للحرية قصيرة المدة مع تلافي ما لها من آثار سلبية. |

The dire effects of short-term deprivation of liberty sanctions, and their failure to achieve the desired goals, have been the focus of attention of the entire international community. This interest was manifested in holding international and regional conferences and meetings to discuss more feasible and less harmful punitive alternatives. On this basis, alternatives to short-term freedom-depriving punishments are among the most important punitive methods developed to keep pace with the development in punitive thought, and their main purpose is to achieve the goals of short-term freedom-depriving punishments while avoiding their disadvantages.<br/>In the past, punishments consisted of rigorous physical pain in order to exact revenge on the offender. At the beginning of the eighteenth century, freedom-depriving punishments of short duration appeared, which took freedom as a place to inflict punishment instead of the body. The modern punitive philosophy differed from its predecessor, so the goal of punishment became reforming and rehabilitating the criminal rather than inflicting pain on him.<br/>in contrast; With the excessive use of short-term freedom-depriving punishments, several negatives emerged, and frequently failed to achieve the most important correctional and rehabilitation goals for the convicts.<br/>Based on the foregoing; It is imperative to search for punitive alternatives that are in line with the commendable objectives sought from those sanctions. Alternatives that are restricted and not restricted to freedom.<br/>According to the foregoing, if the goal of the short-term freedom- depriving punishment in general is to benefit society, the use of punitive alternatives requires a combination of achieving the goals of the short-term freedom-depriving punishment while avoiding its negative effects. |
