| Summary, etc. | شهد المجتمع الدولى العديد من المحاولات لإنشاء قضاء جنائى دولى يختص بالفصل فى الجرائم الدولية الأشد خطورة، و التى تهدد السلم و الأمن الدوليين، و يمكن القول بأن أول اقتراح جدى لإنشاء محكمة جنائية دولية يعود إلى الفقيه السويسرى جوستاف مونييه، حيث اقترح فى عام 1872 إقامة تنظيم قـضاء دولى لمعاقبة مرتكبى الجرائم التى ترتكب ضد قانون الشعوب، و مخالفة أحكام اتفاقية جنيف لعام 1864م المتعلقة بتحسين وضعية المرضى و الجرحى العسكريين، و لكن هذا الاقتراح قوبل بالرفض من قبل الدول التى كانت ترى و قتئذ أن القضاء الوطنى هو المختص بنظر هذه الجرائم. و منذ عام 1919م، بدأت الجهود نحو إنشاء قضاء جنائى دولى يتحقق على أرض الواقع، حيث تم إنشاء العديد من المحاكم، و بعد الحرب العالمية الثانية تم إنشاء محكمة نورمبرج عام 1945م للفصل فى الجرائم المرتكبة من قبل مجرمى الحرب التابعين لدول المحور، و كذلك تم إنشاء محكمة طوكيو عام 1946 لمعاقبة مجرمى الحرب فى الشرق الأقصى. |

| Summary, etc. | The international community has witnessed many attempts to establish an international criminal judiciary specialized in adjudicating the most serious international crimes that threaten international peace and security. It can be said that the first serious proposal to establish an international criminal court dates back to the Swiss jurist Gustave Meunier, who proposed in 1872 the establishment of an international judicial organization To punish the perpetrators of crimes committed against the law of peoples, and the violation of the provisions of the Geneva Convention of 1864 AD related to improving the situation of the sick and the wounded in the military, but this proposal was rejected by the countries that believed at the time that the national judiciary is competent to consider these crimes. Since 1919, efforts towards the establishment of an international criminal justice began to be achieved on the ground, as many courts were established, and after World War II, the Nuremberg Court was established in 1945 to adjudicate crimes committed by war criminals of the Axis Powers, as well as the Tokyo Court was established 1946 to punish war criminals in the Far East |
