تتمثل الفضالة فى قيام الفضولى بامر عاجل وضروري لمصلحة رب العمل وان يكون قاصدا ذلك ،بمعنى ان تنصرف نيتة ، عند اتيان العمل على اجرائة بهدف تحقيق النفع لرب العمل ، والايكون قد ادى العمل امتثالا لامر يفرضة القانون علية ، وقدقرر لها المشرع محموعه من القواعد والاحكام التى تحقق قانونا درجة من التوازن بين مصلحتى كل من رب العمل والفضولى وقد تناولت دراسة موضوع الفضالة فى القانون المدنى فى بابين يسبقهما فصل تمهيدى بينت فية مفهوم الفضاله ثم وقفت على التطور التاريخى لفكرة الفضالة وخصصت الباب الاول للطبيعة القانونية للفضالة وتمييزها عما يشتبه بها من افكار والشروط الواجب توافرها لقيامها ، اما الباب الثانى والاخير فقد تناولت فيه احكام الفضالة من حيث التزامات الفضولى والتزامات رب العمل والجوانب المشتركة بين الفضولى ورب العمل ، وانتهيت بعد عرض تفاصيل هذا الموضوع الى عدة نتائج وتوصيات تصب نحو تعديل بعض المواد التى تمت دراستها فى موضوعنا . |

The contract for the sale of apartments and buildings under construction is considered one of the most important contracts developed on the real estate scene in our modern age as a result of the spread of these contracts at the global level in general and at the level of the countries under study and comparison in particular. What contributed to the creation of this contract in particular is the worsening housing crisis as a result of population inflation and the increase in demand for housing, whether it is an establishment or on plans or under construction. Although the contract for the sale of apartments and buildings under construction came as a solution to the housing crisis and achieved common interests for both the buyer and the seller, it is still fraught with risks, due to the lack of guarantees for this contract, which requires special protection for buyers in accordance with these contracts. The contract is subject to many risks, despite the presence of some aspects of protection for its parties in the general legal rules in the Jordanian and Egyptian laws.<br/>As for the French legislator, he organized this contract according to its provisions, where he took a positive step towards organizing this contract and created for him sufficient guarantees to achieve the interest of the two parties to the contract, especially the buyer, being the weakest<br/>party in this contract. Based on the foregoing, there has become an urgent need to provide legal protection for the buyer in accordance with this contract as he is the weak party in this contract compared to the seller who has the know-how and professional experience in this aspect, and for this legal protection to prevent the greed and greed of some investors in the field of housing and real estate sales, in addition to The specificity of this contract made it raise many theoretical and practical problems, starting with determining its legal nature, which was the subject of great controversy among legal scholars.<br/>However, the special nature Which was the subject of great debate among legal scholars However, the special nature of the place of the contract for the sale of apartments and buildings under construction makes it also raise problems, considering that its place does not exist when the contract is concluded, but it is possible to exist in the future, and this characteristic is a departure from the general rules of the traditional sales contract, which raised several problems related to this sale that require protection for both parties to the contract. |
