حإن و التطور الملحوظ الذي وصل إليه الإنسان: و ما صاحب ذلك من تغير كبير فى سلوكه و أنماط حياته: و القفزات العلمية و التكنولوجية التي حققها و الاعتماد الكبير على الآلة و المصانع تأثير مباشر على البيئة و مكوناتها و عناصرها: الأمر الذي أدى إلى تغير ملموس بجوانب الوسط البيئى الذى يتشاطر فيه الإنسان العيش مع غيره من الكائنات الحية: فكان لزامًا على المجتمعات البشرية التنبه إلى خطورة هذه المتغيرات و الحد منها و العمل على الحفاظ على التوازن البيئى بعناصره الطبيعية و فى حدود نسبها التى خلقها الله تعالى. فأصبحت قضية البيئة من أكثر قضايا العصر اهتمامًا من قبل الجميع: لكونها باتت قضية حياة أو موت: تهدد الكافة حال تدهورها بالاعتداء عليها. و فى هذا العصر: أضحى الوعى البيئى ملموسًا من خلال أسباب عديدة؛ منها: نشاط مؤسسات العمل المدنى فى هذا المجال: و كذلك مسلك المشرع المعاصر فى إصدار العديد من قوانين حماية البيئة و الدفاع عنها: و إقراره للعديد من النصوص العقابية لكل من ينتهك البيئة. و ذلك لأن ما تتعرض له هذه البيئة بكافة أطيافها من أضرار التلوث أصبح قضية جماعية: لأن الضرر البيئى ضرر مُتعدٍّ: فالتلوث لا يعرف حدودًا جغرافية محددة: و لا يعرف زمنا بعينه. و ما حدث من تسربات إشعاعية فى مناطق عديدة من العالم قديمًا و حديثا لهو خير دليل على هذا القول: و من أجل ذلك كله سعى المتخصصون و المهتمون بقضايا البيئة و تلوثها من باحثين: و علماء: و مشرعين إلى الحد من هذه الظاهرة أو على الأقل التقليل من آثارها فى سبيل الوصول إلى الغاية المُثلى وهي منع حدوثها: ولهذا أصدر المشرع فى معظم الدول العديد من التشريعات الخاصة (بحماية البيئة) مُحاولةً منه لدرء مخاطر تلك الظاهرة: من خلال تحديد المسئول عن إحداث تلك الأضرار و عقابه و إلزامه بالتعويض |

It is not hidden that the suspicions on Islam are spread noticeably rather than the other religions; especially the aspect of sanctions. Without any doubt, that distorts the form of Islam and Muslims. This matter is very dangerous because it has a negative effect politically and socially. For all of that, I prepared this research, and dealt with the most important suspicions which are raised around the sanctions in Islamic jurisprudence. At the beginning, I dealt with explaining what the sanctions are in the Islamic jurisprudence, the most important characteristics, the divisions, and the reasons of their dropping. After that, I dealt with the most important suspicions which are raised around the sanctions in Islamic jurisprudence and the responses on them which are divided into: the public suspicions which are raised around the sanctions in Islamic jurisprudence and the responses on them, and the specific suspicions which are raised around the sanctions in Islamic jurisprudence and the responses on them. I dealt with the most important suspicions on "Hudood", "Qisas", "Diyah", "Ta'zir", and I explain the responses on those suspicions in a logical and practical way. After all, I dealt with the goals of who rouse the suspicions, the range of their effects on the reality, the role of the scientists to face all of that, the ways and the means of the resistance of the suspicions. Finally, I crowned my research with a conclusion in which I dealt with the most important results and the recommends which I reached. |
