حإن التطور السياسى للسلطات و المؤسسات فى مصر قد مر بعدة مراحل: أن الدولة فى الإسلام لم تكن دولة مدنية و لم تكن كذلك دولة دينية بل كانت دولة مدنية ذات مرجعية دينية: و كانت الخلافة الإسلامية فيها قائمة على وحدة العالم الإسلامى و قائمة على الشورى و العدل و المساواة: فلم يتضمن الكتاب أو السنة تنظيما تفصيليا لنظام الحكم و اقتصر الأمر على بعض المبادئ العامة حول أسس الحكم و منها الشورى و العدل و المساواة. لذا كان موضوع نظام الحكم من الموضوعات الإجتهادية التى إختلف الرأى بشأنها من زمان إلى زمان و من مذهب إلى مذهب: و قد بنى العلماء نظرياتهم فى الخلافة على ما ورد فى الكتاب و السنة من مبادئ و ما جرى عليه العمل فى عهد الخلفاء الراشدين. لذا فإن السلطة التشريعية هى مركز من مراكز الثقل الأساسية لأى نظام سياسى فهى مؤشر على طبيعة نظام الحكم فى الدولة و دلالة رئيسية على القيم الموجودة داخل منظومة الحكم: و تعد المجالس التشريعية هى المكون الرئيسى للسلطة التشريعية التى هى إحدى السلطات الثلاث فى الدولة الحديثة التى تتخذ من النظام الدستورى أساسا لها: و يعد العمل التشريعى من مظاهر سيادة الدولة |

The political development of the authorities and institutions in Egypt has gone through several stages. The state in Islam was not a civil state, nor was it a religious state. Rather, it was a civil state with a religious reference. The Book or the Sunnah provides a detailed organization of the system of government, and the matter is limited to some general principles about the foundations of governance, including shura, justice and equality.<br/>Therefore, the issue of the system of governance was one of the issues of<br/>jurisprudence on which the opinion differed from time to time and from one sect to<br/>one. The scholars built their theories of the caliphate on the principles mentioned in<br/>the Book and the Sunnah and what was done in the era of the Rightly-Guided Caliphs. Therefore, the legislative authority is one of the main centers of gravity for any political system. It is an indicator of the nature of the system of government in the state and a major indication of the values that exist within the system of governance. The legislative councils are the main component of the legislative authority, which is one of the three authorities in the modern state that is taken from the system. Constitutional basis for it, and legislative work is one of the manifestations of state sovereignty. |
