آثرنا أن نبدأ الدراسة بفصل تمهيدي لندرس فيه التمييز بين جريمتي اغتصاب السندات والتوقيعات وما يرتبط بهما من جرائم ، وخصصنا . الباب الأول من البحث لدراسة ماهية السندات والتوقيعات محل الحماية الجنائية ودرسنا من خلاله السندات والتوقيعات الورقية (التقليدية) في الفصل الأول بينما درسنا في الفصل الثاني السندات والتوقيعات الإلكترونية ، وخصصنا الباب الثاني لدراسة جريمة اغتصاب السندات ودرسنا من خلاله أركان جريمة اغتصاب السندات في الفصل الأول ، وتناولنا اتجاهات محكمة النقض المصرية فيما يتعلق بجريمة اغتصاب . السندات ونظرة في شأن الجريمة في التشريعات المقارنة في الفصل الثاني.<br/>وخصصنا الباب الثالث لدراسة جريمة اغتصاب التوقيعات ودرسنا من خلاله أركان جريمة اغتصاب التوقيعات في الفصل الأول ، بينما تناولنا اتجاهات محكمة النقض المصرية فيما يتعلق بجريمة اغتصاب التوقيعات ونظرة في شأن الجريمة في التشريعات المقارنة في الفصل الثاني ، وتوصلنا إلى مجموعة كبرى من النتائج والتوصيات ، ومن بين تلك النتائج قيام جريمة اغتصاب التوقيعات بالحصول على التوقيع بطريق التخدير . وتحقق جريمة اغتصاب السندات في حالة تمزيق السند .<br/>ومن النتائج الهامة التي توصلنا إليها أن أخذ السند من المجنى عليه بطريق التحايل كفعل أول ثم حجب المجنى عليه عن استرداده من الجاني بالطرق القسرية ، تعد من الوسائل التي تمثل أيضاً إكراهاً مادياً يعدم إرادة المجنى عليه والتي يستخدم فيها الجاني العنف ، إذ إن مجرد أخذ السند من المجنى عليه وإدخاله في حيازة الجاني ومنع يد المجنى عليه من استرداد السند تعتبر طريقة قسرية وعنيفة فهي ذاتها نوع من أنواع الغصب |

We preferred to start the study with an introdactory chapter in which we study the distinction between the crimes of rape bonds and signatures and the related crimes. And electronic signatures. and we devoted the second chapter to the study of the crime of bond rape aac through it we studied the elements of the crime of bond rape in the first chapter, and we dealt with the trends of the Egyptian Court of Cassation regarding the crime of bond rape and a look at the crime in comparative legislation in the second chapter.<br/>We devoted the third chapter to the study of the crime of raping signatures, and we studied through it the pillars of the crime of raping signatures in the first chapter, while we dealt with the trends of the Egyptian Court of Cassation with regard to the crime of raping signatures and a look at the crime in comparative legislation in the second chapter, and we reached a large set of results and recommendations, among which These results are that the crime of raping signatures obtained the signature through anesthesia. The crime of bond rape is realized in case of tearing up the bond.<br/>One of the important findings that we have reached is that taking the bond from the victim by way of deception as a first act and then withholding the victim from recovering it from the offender by coercive means, is one of the means that also represents material coercion that destroys the will of the victim and in which the offender uses violence, as the mere taking of the bond From the victim, bringing him into the possession of the offender and preventing the victim's hand from recovering the bond is a coercive and violent method, which is itself a type of usurpation. |
