| Summary, etc. | وضوع الدراسة هو "حماية المستهلك فى بيوع المسافة" و الذى تتم بإستخدام وسائل الاتصالات الحديثة: حيث أنه فى ظل اختلال التوازن العقدى بين المهنى و المستهلك: و تفوق المهنى على المستهلك من الناحيتين الاقتصادية و الفنية و هو ما يستوجب معه حماية المستهلك الذى يسعى لإشباع حاجته الغير مهنية من السلع و الخدمات: و ذلك عن طريق فرض بعض الالتزامات على عاتق المهنى قبل إبرام العلاقة التعاقدية مع المستهلك بالإضافة إلى بعض الالتزامات الأخرى بعد إبرام العقد و هذه الالتزامات هى :إلزام المهنى بإعلام و تبصير المستهلك و إمداده بالمعلومات اللازمة عن استعمال و إستخدام المنتج على نحو يمكنه الاستفادة منه وفقا للغرض المخصص من أجله. إلزام المهنى بعدم وضع الشروط التى تعتبر بطبيعتها تعسفية فى العقد بينه و بين المستهلك: خاصة شروط الإعفاء و التخفيف من المسئولية. إلزام المهنى بالتسليم المطابق للمواصفات: و فى الموعد المحدد و المكان المتفق عليه فى العقد بينه و بين المستهلك : و فى إطار المدد التى حددها القانون. إلزام المهنى بالضمان و ذلك فى المنتجات المعيبة أوالغير مطابقة للمواصفات: أوالغرض الذى تم التعاقد من أجله و كذلك تحديد مسئوليته عن الأضرار التى تحدث للمستهلك نتيجة استخدامه السلعة و المنتج المعيب. إلزام المهني بأن يعطى الفرصة للمستهلك بعد التعاقد لممارسة حقه فى الرجوع فى التعاقد خلال فترة زمنية معلومة و محددة فى القانون |

| Summary, etc. | The subject of the study is "Consumer Protection in the Distance Selling Through Modern Means of Communication", in light of the contractual imbalance between the professional and the onsumer, and the professional's superiority over the consumer in terms of economic and technical states. This requires the consumer protection which seeks to satisfy its non-professional need of goods and services by imposing some obligations on the rofessional before concluding the contractual relationship with the consumer in addition to some other obligations after the conclusion of the contract. These obligations are:<br/>Obligating the professional to inform and enlighten the consumer, and provide him with the necessary information about using the product in a way that he can benefit from it according to its purpose.<br/>obligating the professional not to set conditions which is considered arbitrary in the contract between him and the consumer, especially the terms of exemption and mitigation of responsibility.<br/>Obligating the professional to deliver in conformity with the specifications at the specified time and place agreed upon in the contract between him and the consumer within the periods specified by the law.<br/>Obligating the professional to guarantee that in defective products, or that does not conform to the specifications, or the purpose for which the contract was made, as well as determining his responsibility for the damages that occur to the consumer, as a result of his use of the defective commodity and product.<br/>The professional is also obligated to give the consumer the opportunity after the contract to exercise his right to return to the contract within a known period of time that specified in the law. |
