ان مفهوم التحكيم التجاري الدولي التحكيم الدولي" إلى جانب التحكيم الوطني والتحكيم<br/>الأجنبي، وبغض النظر عن التباين في تحديد المقصود بهذا المصطلح، فقد تضمنت بعض قوانين<br/>دول مجلس التعاون الخليجي هذا النوع من التحكيم، وبعضها خصه بأحكام مختلفة عن تلك التي تحكم التحكيم الأجنبي، ومن القوانين التي نصت على التحكيم الدولي: قانون التحكيم البحريني سنة 1994م، وقانون التحكيم العماني سنة 1997م، ولكن بقية قوانين دول مجلس التعاون الخليجي اكتفت بالتمييز بين مفهوم التحكيم الوطني والتحكيم الأجنبي، باستثناء نظام التحكيم السعودي حيث<br/>لم يفرق بين نظام التحكيم الأجنبي والوطني، ولم يتطرق للتمييز بين المصطلحين. والحقيقة أنه ليس هنالك معيار موحد يفصل ويميز مصطلح التحكيم الدولي عن التحكيم الأجنبي، بل يرى البعض عدم وجود فرق بين حكم التحكيم الأجنبي وحكم التحكيم الدولي، ويعتبر أنصار هذا الرأي أن كل تحكيم غير وطني هو تحكيم دولي لأن أي حكم تحكيم يعد أجنبيا بالنسبة<br/>لدولة ما بينما يعد وطنياً بالنسبة لدولة أخرى.<br/>ويرى البعض الآخر أنه لابد من التمييز بين حكم التحكيم الأجنبي وحكم التحكيم الدولي خصوصاً بعد قيام بعض القوانين بالنص عليه ووضع معايير لتحديده، ومن ثم فإن اتصال التحكيم بأكثر من نظام قانوني يجعله تحكيما دوليا، ولأن التفرقة بين التحكيم الأجنبي والتحكيم الدولي تؤدي إلى الخلط بين التحكيم الذي يتم بين أفراد أو هيئات خاصة والتحكيم الذي يمكن أن يقع بين الدول<br/>إذ يكون على القاضي الذي ينظر طلب تنفيذ حكم تحكيم أن يكيفه بين فروض ثلاثة هي: أن يكون<br/>حكم التحكيم وطنيا أو أن يكون حكم التحكيم أجنبيا أو أن يكون حكم التحكيم دوليا. |

The concept of international commercial arbitration "international arbitration" is in addition to national arbitration and foreign arbitration. Regardless of the discrepancy in defining the meaning of this term, some laws of the Gulf Cooperation Council countries included this type of arbitration, and some of them singled out provisions different from those governing foreign arbitration. Among the laws that stipulate international arbitration are: the Bahraini Arbitration Law in 1994, and the Omani Arbitration Law in 1997. However, the rest of the laws of the Gulf Cooperation Council (GCC) countries were content to distinguish between the concept of national arbitration and foreign arbitration, with the exception of the Saudi arbitration system, which did not differentiate between the foreign and national arbitration system. It deals with the distinction between the two terms.<br/>In fact, there is no unified standard that separates and distinguishes the term international arbitration from foreign arbitration. Some believe that there is no difference between a foreign arbitration award and an international arbitration award. Supporters of this view consider that every non-national arbitration is an international arbitration because any arbitral award is foreign to a country. While it is national for another country.<br/>Others believe that a distinction must be made between the foreign arbitration award and the international arbitration award, especially after some laws stipulate it and set criteria for its identification. Which takes place between individuals or private bodies and the arbitration that can take place between states, as the judge who considers the application for the implementation of an arbitral award must adapt it between three assumptions: that the arbitral award be national, that the arbitral award be foreign, or that the arbitral award be international. |
