أن المحكمة الجنائية الدولية من القيام بمهامها و ممارسة نشاطها: فقد زودت بعدة أجهزة و هى: "هيئة الرئاسة: الدوائر الاستئنافية و الابتدائية و التمهيدية: قلم المحكمة: و هيئة الادعاء الممثلة فى مكتب المدعى العام بحيث تؤدى كل تلك الهيئات مهامها الموكلة اليها عن طريق التكامل و التعاون فيما بينها و ذلك ضمانا لتحقيق الاهداف التي تقوم عليها المحكمة: حيث تؤدي هذه الأجهزة مهامها تحت اشراف و تنسيق هيئة الرئاسة دون أن تمس هذه الأخيرة باستقلالية جهاز الادعاء التى تميزه عن باقى الأجهزة الأخرى. و بما أن مكتب المدعى العام يعمل بصفة مستقلة عن باقى أجهزة المحكمة: فإن نظامها الأساسى نص على ضرورة توافر جملة من الشروط و المواصفات: سواء فى المدعى العام أو نوابه أو موظفى مكتب الادعاء: و ذلك من حيث أسلوب انتخابهم أو شروط توليهم لمناصبهم و أداء مهامهم و بالمقابل منحهم - نظامها الأساسي - عدد من الامتيازات و الحصانات و الحقوق لأداء مهامهم على أكمل وجه هذا من جهة. و من جهة ثانية خول النظام الأساسي للمحكمة للمدعي العام سلطة تنظيم و إدارة مكتبه: بما فى ذلك مرافقه و موارده و موظفيه: كما تطرق ذات النظام لعلاقة مكتب المدعى العام بباقى أجهزة المحكمة و أيضا الأجهزة الخارجية عن المحكمة بما يضمن استقلاليته و حياده: و لذلك: يعد عمل المدعي العام الركيزة الأساسية فى الدعوى الجنائية الدولية باعتباره هو من يسهر على سيادة القانون: من خلال تحريك المتابعة القضائية أمام المحكمة الجنائية الدولية: و ذلك باتخاذ اجراء التحريات الأولية: ثم الشروع في التحقيق الابتدائى: وصولا لمقاضاة المتهمين بارتكاب الجرائم الدولية أمام المحكمة الجنائية الدولية. و حسب ما تقدم فانه يتضح أن نظام المحكمة الأساسي قد عزز من صلاحيات جهاز الادعاء العام مقارنة بباقي الأجهزة: و هذا ان دل على شيئ هو أهمية الدور الذى يلعبه جهاز الادعاء و التحقيق في المحكمة |

The International Criminal Court has been provided with several organs, namely: "The Presidency, the Appeals, Trial and Pre-Trial Chambers, the Registry of the Court, and the Prosecution Authority represented in the Office of the Prosecutor so that all these bodies perform their tasks entrusted to them through integration and cooperation among them." This is to ensure the achievement of the objectives on which the court is based, as these organs perform their tasks under the supervision and coordination of the Presidency without prejudice to the independence of the prosecution that distinguishes it from other organs.<br/>Since the Office of the Prosecutor General operates independently from the rest of the Court's organs, its statute stipulates the necessity of fulfilling a set of conditions and specifications, whether in the Public Prosecutor, his deputies, or the staff of the Public Prosecution Office, in terms of the method of their election or the conditions for their assumption of their positions and the performance of their duties, and in return granting them - Its statute a number of privileges, immunities and rights to perform their tasks to the fullest on this one hand.<br/>On the other hand, the Statute of the Court empowered the Prosecutor General with the authority to organize and manage his office, including its facilities, resources and employees. The same system also addressed the relationship of the Prosecutor's Office with the rest of the Court's organs as well as the external organs of the Court in a way that guarantees its independence and impartiality. Therefore, the Public Prosecutor's work is the main pillar In the international criminal case, as he is the one who ensures the rule of law, by moving the judicial follow-up before the International Criminal Court, by conducting preliminary investigations, then initiating the preliminary investigation, leading to the prosecution of those accused of committing international crimes before the International Criminal Court.<br/>According to the foregoing, it is clear that the Court Statute has enhanced the powers of the Public Prosecution Service compared to the rest of the agencies, and this is evidenced by the importance of the role played by the Prosecution and Investigation Service in the Court. |
