| Summary, etc. | هدفت هذه الدراسة إلى تحديد نوع المسئولية المدنية التى يخضع لها مقاول البناء من الباطن: و بما أن هذا الأخير لا يخضع لأحكام المسئولية العشرية: فإنه يخضع - طبقًا للقواعد العامة فى القانون المدنى - لنوعين من المسئولية المدنية: الأولى: المسئولية العقدية لمقاول البناء من الباطن فى مواجهة المقاول الأصلى: و تنشأ هذه المسئولية عن إخلال مقاول البناء من الباطن لأحد الالتزامات - الرئيسية أو الفرعية - المُلقاة على عاتقه تجاه المقاول الأصلى: على أن يلحق بهذا الأخير ضرر نتيجةً للخطأ العقدى: و بالتالى يكون للمقاول الأصلى الحق فى المطالبة بالتعويض خلال مدة التقادم: و لا يعفى من هذه المسئولية إلا إذا أثبت أن ذلك الخطأ كان نتيجة لسبب أجنبى لا يد له فيه. الثانية: المسئولية التقصيرية لمقاول البناء من الباطن فى مواجهة رب العمل و الغير: و تتأسس هذه المسئولية على أساس الخطأ الشخصى لمقاول البناء من الباطن الواجب الإثبات تجاه الغير: أو على أساس مسئولية المتبوع عن أعمال تابعه: أو مسئوليته الناجمة عن حراسة الآلات الميكانيكية أو الأشياء الخطرة: فإذا وقع ضرر للغير بإحدى هذه الأسباب وجب على مقاول البناء من الباطن تعويض المضرور عن الضرر المباشر المتوقع و غير المتوقع. و قد انتهت هذه الدراسة إلى عدد من النتائج أثمرت عددا من التوصيات أهمها: ضرورة خضوع مقاول البناء من الباطن للضمان العشرى تجاه المقاول الأصلى: و يشترك مع هذا الأخير بالتضامن فى المسئولية العشرية تجاه رب العمل |

| Summary, etc. | The aim of this study is to determine the type of civil liability to which the building subcontractor is subject, and since the latter is not subject to the provisions of decennial liability, it is subject according to the general rules in civil law to two types of civil liability:<br/>The first: Contractual liability of the subcontractor to the construction vis-à-vis the original contractor: This liability arises from a breach by the sub-construction contractor of one of the obligations major or subsidiary incurred by him towards the original contractor, provided that the latter inflicts damage as a result of the contractual error, and thus the original contractor has The right to claim compensation during the statute of limitations period, and is not exempt from this liability unless it is proven that that error was the result of a foreign cause that has no control over it.<br/>The second: Negative liability of the subcontractor to the construction vis-à-vis the employer and others: This liability is based on the personal error of the subcontractor that must be proven towards others, or on the basis of the responsibility of the subcontractor for the work of his subordinate, or his liability resulting from guarding mechanical machinery or dangerous objects, If damage occurs to a third party due to one of these reasons, the building subcontractor must compensate the injured person for the expected and unexpected direct damage.<br/>This study concluded with a number of results that yielded a number of recommendations, the most important of which are: The need for the subcontractor to be subject to the ten-year guarantee towards the original contractor, and to jointly share with the latter in the ten-year liability towards the employer.<br/>li |
