هدفت هذه الدراسة إلى تحقيق الحماية المدنية لمستهلك المنتج الصناعى المعيب كعنوان رئيسِ للرسالة: و الذى يهدف إلى إيجاد منظومة متكاملة لحماية المستهلك. فتناولت الدراسة بدايةً مجال حماية المستهلك من حيث الأشخاص و المنتجات و الحقوق الكفيلة لحماية المستهلك فى فصل تمهيدى. و كما تناولت الدراسة الأسس الموضوعية لحماية المستهلك فى الباب الأول: حيث شملت الحماية المدنية من الأضرار التى تصيب المنتج ذاته كفصل أول: تم التركيز فيه على الإطار القانونى لضمان العيوب الخفية: و دور القضاء و التشريع فى تحقيق الحماية للمستهلك كمبحث أول: و تناولت الدراسة ضمان المطابقة و دورها فى تحقيق الحماية كمبحث ثان. و تناولت الدراسة فى الفصل الثانى من هذا الباب الحماية المدنية من الأضرار التى تصيب المستهلك فى شخصه و أمواله: فى ظل قاعدة الخطأ كمبحث أول: و فى ظل المسئولية الموضوعية كمبحث ثان. و أما فى الباب الثانى فقد تناولت فيه الدراسة دعوى الاستهلاك: و تم التركيز فيها على الأسس الإجرائية و الموضوعية فى دعوى الاستهلاك: حيث شمل الفصل الأول على أركان دعوى الاستهلاك من حيث الاختصاص و الصفة و دور جهاز حماية المستهلك فى تمثيل المستهلك و تحقيق الحماية: كما شملت الدراسة فى هذا الفصل أنواع دعوى الاستهلاك التى يمكن رفعها من المستهلك كدعوى الضمان أو دعوى التعويض. و فى ذات الصدد فقد تناولت الدراسة فى الفصل الثانى من هذا الباب إثبات دعوى الاستهلاك و وسائل دفعها: و التى تم التركيز فيها على الوسائل الممكنة لإثبات العقد التقليدي والإلكتروني ووسيلة الخبرة كمبحث أول: و أما المبحث الثانى من هذا الفصل فقد تناول وسائل دفع دعوى المسئولية الإجرائية و الموضوعية: و المتمثلة فى التقادم و وسائل الإعفاء العامة والخاصة. وانتهت الرسالة بأهم النتائج و التوصيات التى توصلت إليها: و مذيلة بفهرسى المراجع و المصادر: و فهرس الموضوعات |

This study aimed to achieve civil protection for the consumer of the defective industrial product as the main title of the message, which aims to create an integrated consumer protection system.<br/>The study addressed the beginning of consumer protection in terms of persons, products and rights to consumer protection in a preliminary chapter. The study also addressed the merits of consumer protection in Title I, where civil protection from damage to the product itself as a first chapter was included, focusing on the legal framework to ensure hidden defects, and the role of the judiciary and legislation in achieving consumer protection as a first research, The study examined ensuring conformity and its role in achieving protection as a second research. The study dealt with civil protection against the damage to the consumer in person and money, under the rule of error as a first research, and under objective responsibility as a second research.<br/>In the second part, the study dealt with the consumption suit, which focused on the procedural and objective grounds of the consumption suit, where the first chapter included the elements of the consumer claim in terms of competence and characteristics and the role of the Consumer Protection Agency in consumer representation and protection, as well as the types of consumer claim that could be filed by the consumer, such as the insurance or compensation claim. In the same vein, the study dealt with the proof of the claim of consumption and the means of payment, in which the focus was on possible means of proving the traditional and electronic contract and the means of expertise as the first research, and the second topic of this chapter dealt with the means of paying the claim of procedural and objective liability, which is the statute of limitations and the means of public and private exemption.<br/>The letter ended with the most important findings and recommendations, followed by the index essays of references and sources, and the index of topics |
