أدى التطور التقني في مجال الاتصالات الى ظهور أنماط جديدة من الخدمات البنكية ، بهدف تقليل الجهد والوقت، ومن ذلك تسوية القيود الحسابية الناشئة عن العمليات البنكية طبقاً لآليات الكترونية دون ان يتضمن ذلك نقلاً مادياً للنقود، ويتم ذلك من خلال تسوية الديون بين حسابات مصرفية أو بين البنوك، وشاع اطلاق تسمية المقاصة الإلكترونية بأنها عملية التي يتم من خلالها تبادل معلومات الشيكات بين البنوك بموجب صور الكترونية ، والمسؤولية المدنية للبنك أهمية بالغة في وقتنا الحاضر نظراً للتطورات التي عرفها القطاع البنكي في ظل الاعتماد الكبير على مخرجات التكنولوجيا الحديثة والتي منها المقاصة الإلكترونية للشيكات من جهة وعلى مستوى حجم المعاملات المنفذة من طرف البنوك من جهة اخرى ، فالأنشطة التي تمارسها البنوك أصبحت تمس مختلف جوانب حياة الأفراد في المجتمع ولم يعد أحد قادر على الاستغناء<br/>عن الخدمات التي تقدمها. |

The technological development in the field of communication has<br/>resulted in new patterns of banking services in the aim to reduce effort<br/>and time in the settlement of accounting entries of banking transaction<br/>according to electronic mechanisms and without real transfer of funds<br/>and in order of settlements of debts between banking accounts or<br/>between the banks as the new name of electronic settlements becomes<br/>known as the exchange of checks information between banks and by<br/>virtue of electronic forms, therefore the civil liability of the bank is of<br/>utmost important in the present time due to the evolution of banking<br/>sector and the grade dependence in the output of modern technology<br/>like the electronic settlement by checks and the amount of dealing of the<br/>banks of the other hand as the activities of the bank are included in the<br/>different aspects of individual life and no one can be deprived from its<br/>services. |
