| Summary, etc. | تهدف الدراسة فى هذا البحث إلى معالجة موضوع عقد العمل عن بعد: و ذلك فى ضوء الاتفاق الإطارى الأوروبى لعام 2002. و من أجل تحقيق هذا الهدف: قمنا بتقسيم البحث إلى بابين: الباب الأول: يتناول العمل عن بعد كنمط مستحدث: و المقصود بعقد العمل عن بعد و أطرافه: و علاقة التبعية فى عقد العمل عن بعد: و المراحل التى تسبق إبرام عقد العمل عن بعد: و إبرام عقد العمل عن بعد. أما الباب الثانى: فقد تناول التزامات العمل عن بعد: و التزامات صاحب العمل: ووقف عقد العمل عن بعد: وشروطه وتطبيقاته: و إنهاء عقد العمل عن بعد محدد المدة و غير المحدد المدة. ثم تأتى خاتمة الدراسة و التوصيات و التى تضمنت مسئولية صاحب العمل عن السلامة و الصحة المهنية لمكان العمل: و تنظيم العمل عن بعد تشريعيًا: عقد دورات تدريبية للعاملين عن بعد: و أصحاب الأعمال؛ و ذلك لتثقيفهم بأسلوب الإدارة الجديد فى نمط العمل عن بعد: على أن تتحمل الدولة عبء القيام بعقد هذه الدورات بالمشاركة مع المنظمات النقابية: و توسيع رقعة البنية التحتية التكنولوجية: لتلقى بظلالها على جميع أنحاء الجمهورية |

| Summary, etc. | The study in this research aims to address the issue of the telework contract, in light of the European Framework Agreement of 2002. In order to achieve this goal, we divided the research into two chapters: Chapter One deals with remote work as a new type, and what is meant by the telework contract and its parties, and the dependency relationship in the telework contract, the stages that precede the conclusion of the telework contract, and the telework contract.<br/>As for the second chapter, it dealt with the obligations of telework, the obligations of the employer, the suspension of the telework contract, its terms and applications, the termination of a fixed-term and unlimited-term telework contract. Then comes the conclusion of the study and recommendations, which included the employer's responsibility for the occupational safety and health of the workplace, the legislative regulation of remote work, the holding of training courses for remote workers and employers; This is to educate them about the new management style in the remote work style, provided that the state bears the burden of holding these courses in partnership with trade union organizations, and expanding the technological infrastructure to cast shadows all over the Republic. |
